Author: Yashwant Varma

Bench: Yashwant Varma

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 81

Case :- WRIT - A No. - 8334 of 2020

Petitioner :- Deependra

Respondent :- State Of U.P. And 2 Others

Counsel for Petitioner :- Santosh Kumar Shukla,Akhileshwar Pratap Singh,Kuldeep Kumar Sharma

Counsel for Respondent :- C.S.C.,Aakash Rai

Hon'ble Yashwant Varma,J.

Heard learned counsel for the petitioner, the learned Standing Counsel and Sri Aakash Rai, learned counsel for the respondent nos.2 and 3.

The instant petition has been filed for seeking the following reliefs:

"I. Issue a writ, order or direction in the nature of certiorari quashing the final result dated 18.03.2020 of the P.G.T. Examination 2016 of the posts of Lecturer sociology in pursuance of the Advertisement No.02/2016.
II. Issue a writ, order or direction in the nature of mandamus directing the Respondent Authority to call the petitioner for participating in the Interview Test under open category candidates for the post of lecturer Sociology within specified period as stipulated by this Hon'ble court."

It appears that on 14 October 2020, the Court took note of the contention raised by the learned counsel for the petitioner that he had obtained marks equal to the cut off mark of the General category which had been placed at 111. It was urged that despite that he was not called to participate in the interview.

Sri Rai on instructions however apprises the Court that cut off mark for OBC category candidates at the written examination stage was fixed at 396.6704 whereas the petitioner had obtained only 393.1278. Learned counsel at this stage then submits that the figure 111 has been wrongly mentioned in paragraph 10. He is, however, not in a position to indicate or to state that the cut off marks for General category candidates at the written examination stage were either equivalent to or less than 393.1278 i.e. marks obtained by the petitioner here.

In view of the aforesaid, the Court finds no ground to issue the writs as prayed for. The petition stands dismissed accordingly.
