34. Fresh Poll in the case of Destruction etc. or Ballot Boxes.
(1)If at any election any ballot box used at the polling station, or at a place fixed for the poll is unlawfully taken out of the custody of the Presiding Officer or in any way tampered with or is accidentally or intentionally destroyed, lost or damaged and the Deputy Commissioner or the Sub-Divisional Officer as the case may be, is satisfied that in consequences thereof the result of the polling at that polling station or place cannot be ascertained he shall-(a)declare the polling at the polling station to be void;(b)report the matter forthwith to the State Election Commission;(c )request the State Election Commission to appoint a day for fresh poll at such polling station.(2)The provisions of the Act and of any rules or orders made thereunder shall apply to the original poll.
