Information soughtand background of the case:
Vide RTI application dated 24.09.2014, the complainant sought information under 5 points regarding selection procedure of the graduate apprentices in 2014, wherein the applicant had applied.
The CPIO responded vide letter dated 10.11.2014 providing point wise information against the RTI application. The complainant preferred a first appeal not satisfied with the response of the CPIO and the FAA vide order dated 10.12.2014 disposed of the Second appeal upholding the reply of CPIO. Feeling aggrieved the complainant approached the Commission.
Relevant facts emerging during hearing:
During the hearing both parties appeared and placed forth their respective contentions. The applicant wanted to know the reason why the Respondent has fixed their cut off marks for selection of apprentices at such a high percentage of 60% despite there being no legal stipulation in the Apprentices Act. At this the Respondent has reasoned stating that the best of the talents from across the country are selected in order to serve the nation with the maximum efficiency and best of services. Though the case has been registered as a Complaint, since the applicant has sought information vide his case before the Commission, the Commission converts the case into a Second Appeal for proper adjudication thereof.
Decision:
After hearing parties and perusal of record, the Commission is of the opinion that the Respondent has reasoned well in response to the Applicant's query. However, response against the queries number 3 and 5 of the RTI application are not accurate. Hence it is directed that the respondent shall provide number of candidates against query number 3 and list of selected students against query number 5 to the applicant, within a week of receipt of this order.
The case is disposed of on the above terms.
