1. Vide Reference No.F.3(238)/22/Ref./wd./Lab/887 dated 09.05.2022, the following Reference from Dy. Labour Commissioner was received for adjudication, sent by him U/Sec.10(1)(c) and 12(5) of Industrial Disputes Act, 1947 read with Notification No.s110011/2/75/DK(IA) dated 14.04.1975 and Notification No.F.1/31/61/616/Estt./2008/7458 dated 03.03.2009 in respect of industrial dispute between the Workmen and Management: "Whether the services of Smt. Reena Tyagi and 05 Others (as per "Annexure A") are entitled for Legal Dues, and if so, to what relief are they entitled and what directions are necessary in this respect?" LIR No.1077/2022

2. Reference in this case was received on 28.05.2022. Since the addresses of the Workmen were not provided in the Reference, therefore, Notice of Reference was issued to them through Labour Union and the said Notice was duly served on 14.10.2022. But despite said service, neither anybody had appeared on behalf of the Workmen nor any Statement of Claim was filed. However, in the interest of justice, four weeks' time was granted to Workmen vide order dated 10.11.2022 for filing their Statement of Claim on record. But again, neither anybody had appeared on their behalf nor any Statement of Claim was filed. However, in the interest of justice, last & final opportunity was given to them vide order dated 15.05.2023 for filing their Statement of Claim on 26.07.2023. But despite grant of last & final opportunity and repeated calls made today since morning, neither anybody has appeared on behalf of the Workmen nor any Statement of Claim has been filed till date. Thus, it appears that the Workmen are not left with any grievance against the Management and due to this reason, they are not coming forward to file their Statement of Claim.

3. Hence, No Dispute Award is passed and Reference is answered accordingly. Copy of Award be sent to Labour Commissioner for publication. File be consigned to Record Room.
