DATE : October 09, 2018 This application has been filed under Section 11 of the Arbitration and Conciliation Act, 1996. It is not in dispute that the agreement dated 19/02/2014 contains a clause of arbitration.

In the reply filed on behalf of the non-applicant it is stated that the claim as has been agitated by the applicant has been duly satisfied.

In the light of the decision in Duro Felguera, S.A. vs. Gangararam Port Ltd. (2017) 9 SCC 729 the objection in that regard can be gone into by the learned Arbitrator who would be so appointed.

Statement of disclosure be called from Shri R.C. Chavan (Retired Judge, High Court) within period of four weeks from today.
