O R D E R (ORAL)
Per: Justice Ranjit More, Chairman The present C.P. has been filed alleging non-compliance of the order dated 19.12.2023 passed in O.A. No. 2567/2023. In the present C.P., this Tribunal had passed the following order on 09.12.2025:
"Vide order dated 19.12.2023 in O.A. No.2567/2023, this Tribunal directed the respondents to convene the DPC in respect of the applicants immediately and to consider their cases for promotion to the post of SSO (Grade-I) within a period of six weeks. This Tribunal further directed the respondents to prepare a year-wise panel for promotion to the said post and to accord consequential benefits to the applicants in accordance with law. As the said order has not been challenged before the Hon'ble High Court, it has attained finality.
The petitioner has approached this Tribunal in the present CP, making a grievance of non-compliance of the aforesaid order dated 19.12.2023. Notice in this CP was issued on 22.10.2024, yet, despite sixteen adjournments, the respondents have not complied with the Tribunal's directions.
Mr. R. S. Rana, learned counsel for the respondents, submits that the matter has been referred to the DoP&T for clarification, as according to the respondents, the rules do not permit grant of consequential benefits as directed by the Tribunal.
In our opinion, the stand taken by the respondents is wholly unjustifiable. The respondents are duty-bound to comply with the order of this Tribunal, and if they were aggrieved, the proper course was to challenge the same before a higher Court. They cannot decline implementation on the ground that clarification from DoP&T is awaited/required.
Mr. R. S. Rana, learned counsel for the respondents, requests for some more time.
In the above circumstances, reluctantly and as a last chance, we grant the request of learned counsel for the respondents.

2. The respondents, being aggrieved by the original order dated 19.12.2023 passed in the subject O.A., approached the Hon'ble Delhi High Court by filing W.P.(C) No. 1117/2026. In the said writ petition, a grievance was also raised with regard to the order dated 09.12.2025 passed in the present C.P.
3. The Hon'ble Delhi High Court, in paragraphs 10 to 15 of its judgment, observed as follows:
"10. This Court has heard the submissions advanced by the learned counsel representing the parties.
11. At the outset, a perusal of Paragraph No.9 of the Impugned Order, makes it evident that the Tribunal disposed of the O.A. filed by the Respondents, directing the Petitioners to convene the DPC within a period of six weeks and, thereafter, prepare year-wise panels for promotion to the said post and accord consequential benefits.
12. Whereas, this Court has been apprised that the Petitioners, in compliance with the directions contained in the Impugned Order, have held the DPC and have also prepared the year-wise panels. It is also the case of the Petitioners that the Impugned Order has thus been complied with, and the Respondents are entitled only to the benefits specified in Paragraph No.6 of the Promotion List dated 08.03.2024.
13. In the considered view of this Court, since the Petitioners have convened the DPC, prepared the year-wise panels and granted promotion in accordance with the Impugned Order, any grievance pertaining to the scope of consequential benefits granted under Paragraph No.6 of the Promotion List, cannot, therefore, form the basis of initiating a contempt proceeding. In such circumstances, the recourse, if at all, available to the Respondents is limited to challenging the action undertaken by the Petitioner, by instituting a fresh O.A. before the Tribunal.
14. It is well-settled that the jurisdiction to initiate contempt proceedings arises only in cases of willful disobedience of clear and categoric directions. However, in cases alike, where a subsequent order has been passed in compliance with directions issued by the Tribunal, whether right or wrong, the appropriate remedy for the aggrieved party lies in filing a fresh O.A. to challenge/test its correctness.

No. 822/2024 of this jurisdiction, converting the proceedings into a surrogate vehicle for testing the merits rather than acting as a shield for the authority of judicial orders. Such an approach does not commend itself to the conscience of this Court, which is mindful that the sanctity of contempt jurisdiction lies in enforcement of authority and not in relitigation of disputes over compliance"
4. Consequently, the Hon'ble Delhi High Court set aside the order dated 09.12.2025 passed in the present C.P., with liberty to the applicant to file a fresh O.A. before this Tribunal, and disposed of W.P.(C) No. 1117/2026.
5. Thereafter, the applicant approached the Hon'ble Supreme Court by filing S.L.P. (C) No. 7094/2026 challenging the aforesaid order of the Hon'ble Delhi High Court. The said S.L.P. was disposed of by the Hon'ble Supreme Court on 16.03.2026 by passing the following order:
"1. Heard learned counsel appearing for the petitioners and perused the material placed on record.
2. Perusal of the impugned order indicates that the High Court while disposing the contempt petition permitted the petitioners herein to avail the remedy of approaching the tribunal by filing fresh original application.
3. Accordingly, the special leave petition is disposed of with liberty to the petitioners to avail appropriate remedies as available in law with just exceptions."
6. Subsequently, M.A. No. 1823/2026 has been filed by the applicant seeking directions to the respondents to comply with the order dated 19.12.2023.
7. In the above circumstances, in our view, nothing survives for consideration in the present C.P. 8. Learned counsel for the applicant has relied upon the decision in GNCTD v. Rakesh Beniwal, W.P.(C) No. 7424/2013, to contend that the respondents ought to grant consequential benefits. The said contention is a matter of adjudication on merits and would be available to the applicant in fresh proceedings, if initiated.
9. Learned counsel for the applicant has also expressed an apprehension that fresh proceedings may be barred by the principle of res judicata. We are unable to appreciate the said apprehension in view of the liberty expressly granted by the Hon'ble Delhi High Court and the Hon'ble Supreme Court. Moreover, the respondents have passed a fresh order in compliance of the order dated 19.12.2023, which itself gives rise to a fresh cause of action.
10. In light of the above, the present C.P. stands closed.
