Background

1. The Applicant filed an RTI application dt.5.10.08 with the CPIO, BSNL, Solan.

He requested for information related to Government quarters including rulings on vacating the quarters after retirement, deduction of license fee, retention of quarters after retirement etc. The CPIO replied on 11.12.08 enclosing the information received from DE(Admn), BSNL, Solan, HP dt.24.11.08. Not satisfied with the information, the Applicant filed an appeal dt.9.1.09 with the Appellate Authority. The Asst. Director Telecom (Estt.) replied on 14.1.09 stating that information sought by the Applicant in paras 4 to 6 of his appeal is additional information and may be sought vide a fresh RTI application. The Applicant filed a second appeal dt.14.5.09 before CIC reiterating his request for information.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing on August 17, 2009.

3. Mr. Gurbakhsh Singh, CPIO cum DGM represented the Public Authority

4. The Applicant was not present during the hearing Decision

5.. The Respondent vide his rejoinder dt.23.5.09 stated that the reply with respect to points 1 to 3 as received from the concerned units was supplied to the Appellant a second time on 23.6.09 and that the Appellant was also advised to approach the PIO for additional information which he had sought at the stage of the first appeal.

6. The Commission on review of the information provided noted that complete information has been furnished to the Appellant and accordingly disposes off the appeal.

7. The Commission directs the CPIO to show cause as to why a penalty of Rs.250/- per day (Maximum Rs.25,000) should not be levied on him for not responding to the RTI application within the stipulated time prescribed under the RTI Act. The response should reach the Commission by 17.9.09.
