Accordingly, the application stands disposed of. W.P.(C) 3505/2021 Present writ petition has been filed challenging the order dated 20 th May 2020 issued by the Respondent No. 2 to the extent that the benefit of Non-Functional Financial Upgradation [NFFU] in Junior Administrative Grade [JAG] level has been granted to the Petitioners from belated dates.
Petitioner further seeks directions to the Respondents to grant Non- Functional Financial Upgradation for JAG grade to the Petitioners by extending relaxation of requirement of Pre-Promotional Course on the grounds of delayed detailment of the Petitioners by the Respondents and benefit of the Non-Functional Financial Upgradation for JAG grade to the Petitioners from the date of eligibility and in accordance with relevant DoPT Signature Not Verified Digitally Signed By:MANJEET KAUR Signing Date:18.03.2021 13:10:57 OMs along with interest, arrears payable and all consequential benefits.
Learned counsel for the Petitioner emphasises that similarly situated Officers of the BSF who have been arbitrarily denied the benefit of NFFU in JAG grade have approached this in the matter of V.P.Chacko v. Union of India, WP (C) No. 9391/2020 wherein this Court was pleased to issue notice to the Respondents and the said matter is listed for hearing on 20th April 2021.

Mr. Alok Singh, learned counsel for the respondents accepts notice. He prays for and is permitted to file a counter affidavit within four weeks.
Rejoinder affidavit, if any, be filed before the next date of hearing. List on 20th April, 2021 along with W.P.(C) No. 9391/2020.
