India, praying this Court to issue a Writ of Certiorarified Mandamus, to call
for the impugned order passed by the third respondent under Na.Ka.No.
06/R1-PS/INS/SVG/2024 dated 12.07.2024 and to quash the same as illegal
and further to direct the third respondent to grant permission and necessary
protection to conduct the Adalum Padalum dance program in connection
with 28th year Madhu Yeduppu Festival of Arulmigu Sri Muthumariyamman

ORDER
This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus, as against the impugned order passed by the third respondent under Na.Ka.No.06/R1-PS/INS/SVG/2024 dated 12.07.2024 and to quash the same as illegal and further to direct the third respondent to grant permission and necessary protection to conduct the Adalum Padalum dance program in connection with 28th year Madhu Yeduppu Festival of Arulmigu Sri Muthumariyamman Temple situated at Somasundara Nagar, Kalaiyarkovil, Sivagangai, scheduled to be held on 19.07.2024.

The learned Counsel for the petitioner submits that petitioner's representation dated 11.07.2024, for conducting the adal padal programme to be held on 19.07.2024 was rejected by the respondent police on the 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD) No.16088 of 2024 ground of law and order problem. Further, he submits that there is no scope for any law and order problem. The festival is being conducted by the entire villagers and there is no group and there is no possibility of any law and order problem. The petitioner also ensures that the festival will be conducted without any law and order problem. In the event, if any law and order problem arises, the petitioner undertakes to take the responsibility for the same. That apart, the learned Counsel for the petitioner also submits that for getting a permission to conduct the adal padal festival, he is ready to do some social service to the Government School, namely, VNT Government Higher Secondary School, Sanmuganathapattinam, Sivagangai, by providing a water purifier to the tune of Rs.25,000/-.

Considering the submissions made by the learned Counsel for the petitioner, the undertaking given by the petitioner that he will be responsible for the law and order problem if any arises and also donating a water purifier to the said Government School, the impugned order is set aside with a liberty to the petitioner to file a fresh application along with the receipt for the purchase of water purifier and the acknowledgement from the Head Master of the said Government School that he has provided a water 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD) No.16088 of 2024 purifier to the tune of Rs.25,000/-. On such receipt and acknowledgement, the third respondent shall re-consider the petitioner's representation and grant permission for conducting the adal padal programe on 19.07.2024 as per the circular of the Director General of Police, Tamil Nadu/Head of State Police Force, Chennai-4, in Rc.No.007301/General I(I)/2019, dated 09.04.2019
4. Accordingly, this Writ Petition is disposed of. No costs.
