35. Prosecution, Magistrate's power etc.
(1)No prosecution for any offence punishable under this Act shall be instituted except with the previous sanction of the Chief Executive Officer.(2)No Court inferior to that of a magistrate of the first class shall try an offence punishable under this Act. Any proceedings in respect of an offence under this Act or any regulations made thereunder shall be tried summarily.(3)Notwithstanding anything contained in section 32 of Code of Criminal Procedure, 1973, it shall be lawful for any court of a magistrate of the first class to pass any sentence authorised by this Act, in excess of its power under the said section.
