HON'BLE MRS. JUSTICE SABINA Order 29/05/2020 Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No. 191/2018 registered at Police Station Tapukara, District Alwar (Raj.) for offences under Sections 418 and 380 of Indian Penal Code, 1860.

Learned counsel for the petitioner has submitted that the petitioner and the complainant were running a private school. FIR-in-question has been lodged by levelling false allegations against the petitioner. Similar FIRs were registered against the petitioner and in the said FIRs, negative final reports have been submitted by the investigating agency. In a case filed under Section 138 of the Negotiable Instruments Act, 1881 by the petitioner against the complainant, cognizance has been taken by the court.

(2 of 2) [CRLMB-1966/2020] Learned State counsel has opposed the petition. Petitioner and the complainant were running a private school. As per the contents of the FIR, petitioner had misappropriated the record of the school and had also stolen cheques. FIR was registered on 08.06.2018, whereas, complaint was lodged by the petitioner under Section 138 of the Negotiable Instruments Act, 1881 in the month of August, 2018.

Keeping in view the seriousness of the allegations levelled against the petitioner, no ground for grant of anticipatory bail to him is made out. Petitioner might be required for custodial interrogation.

Dismissed.
