On perusal of the order dated 03.05.2019 of the Hon’ble Chamber Judge, it transpires that none appeared there also and the appeal was to stand abated as against the first respondent.
Respondent No.2 is the mother of respondent No.1. The eviction proceedings filed by the appellant against respondents succeeded before the first two Courts but in exercise of revisional jurisdiction, the High Court reversed the finding of the Rent Controller and the appellate authority.
It appears that either the parties have lost interest or may have settled the dispute, more than a decade having elapsed. That appears to the reason for the absence of both the sides and no steps having been taken to bring the legal representatives on record.
The appeal is dismissed for non-prosecution.
