ORDER:
This is a writ of Mandamus filed by the petitioner seeking for a direction to the respondents for release of the vehicle Lorry Bearing No. AP-16-TJ-4991 of the petitioner, as the same has been seized by the 2nd respondent without following due process of law.
02. Heard the arguments of learned counsel for the petitioner and learned Government Pleader for Mines and Geology.
03. The petitioner is the registered owner of the vehicle Bearing No. AP-16-TJ-4991. The 2nd respondent has seized the vehicle of the petitioner alleging that the petitioner is transporting the sand illegally.
04. The contention of the petitioner is that he is the owner of the vehicle Bearing No. AP-16-TJ-4991 and he has given his vehicle on hire to the accused.
05. Learned Government Pleader for Mines and Geology submits that in view of the recent G.O. issued by the Government and as per Clause 16 of the G.O.Ms.No.71 dated 04.09.2019, the respondents are directed to release the vehicle by collecting the penalty.
06. Considering the submissions of both the counsel, directing the respondents to collect the appropriate penalty as per Clause 16 of the 2 G.O.Ms.No.71 dated 04.09.2019 and release the vehicle Bearing No. AP-30-TA-1818.
07. With these observations, this writ petition is disposed of. There shall be no order as to costs.
As a sequel, Interlocutory Applications pending, if any, in this Petition shall stand closed.
