CM(M) 153/2021

1. This petition has been filed by the petitioner being aggrieved of the adjournment granted by the learned Additional Rent Controller (ARC) to consider the application seeking leave to defend filed by the respondent herein in Eviction Petition being E-107/2020 (new number E-330/2020).

2. The Eviction Petition has been filed by the petitioner under Section 14(1)(e) of the Delhi Rent Control Act, 1958 (hereinafter referred to as the 'Act'). The same was filed in October, 2020. The respondent has filed his application seeking leave to defend the said petition. Pleadings therein are stated to be complete and the application was ripe for hearing.

3. The petition was listed before the learned ARC on 11.02.2021 and has now been adjourned to 29.07.2021.

4. As the petition is under Section 14(1)(e) of the Act to which the special procedure prescribed under Section 25B of the Act is applicable, I find the grievance of the petitioner to be justified. Accordingly, the learned ARC is requested to at least consider and dispose of the application of the respondent seeking leave to defend on or before 31.07.2021. The petitioner shall file an application seeking early hearing of the application before the learned ARC. The respondent is directed to cooperate with the learned ARC for early disposal of the application seeking leave to defend.

5. The petition is disposed of with the above direction. There shall be no order as to cost.
