1. Heard Mr. Satish Maneshinde, learned Senior Advocate for the Petitioners and Mr. Amarendra Mishra, learned Counsel for the Respondent No.2-Union of India.
2. The Petitioner's grievance in the present Petition is that in the course of conducting summary of evidence under the proceedings of the TA-42430L under the Army Act, 1950, the Petitioners are repeatedly being summoned. According to the learned Counsel for the Petitioners, despite there being provision for recording evidence through video conferencing and appointment of a fully authorized and cooperative representative, the action of the the Respondent in mechanicaly issuing summons to each of the Petitioner's employees and compelling their personal attendance and summoning the Petitioners repeatedly is arbitrary. He submits that the Petitioner No.2 was summoned as many as eight times to Udhampur. Learned Senior Counsel for the Petitioner has also filed an affidavit of the Petitioner No.2 making grievance as against some of the officers.
3. Mr. Amarendra Mishra, learned Counsel for the Respondent disputes the said allegations.
4. Be that as it may, since Mr. Amarendra Mishra states that the Petitioner will be given an advance notice of atleast one week before their summoning, the grievance of the Petitioners would not survive.
Mr. Amarendra Mishra further states that after the first summons are issued, where the Petitioners will be required to remain present physically with the documents as sought under witness summons, the recording of any further evidence will be done through video conferencing. He submits that he is making the said statement only with respect to the proceedings which are currently on board i.e. recording of summary evidence. In view of the statement made by Mr. Manisha 4/6 ::: Uploaded on - 22/12/2025 ::: Downloaded on - 26/12/2025 21:20:13 ::: 3-WP-16031-2025.doc Amarendra Mishra, learned Counsel for Respondent No.2, Mr. Satish Maneshinde, learned Senior Advocate does not press this Petition. He states that Petitioner No.2 shall attend the proceedings physically on 12/01/2026, the Petitioner No.3 shall attend the proceedings physically on 13/01/2026, the Petitioner No.4 shall attend the proceedings physically on 14/01/2026 and the Petitioner No.5 shall attend the proceedings physically on 15/01/2026.
5. Needless to state, that the summons are to be issued to the Petitioners accompanied by the list of documents as may be sought from the Petitioners. Needless to state that, after the appearance of the Petitioners thereafter, it is open for the Respondent-Authorities to record the further summary of evidence of the Petitioners through video conferencing.
6. Needless to state that, if further summary of evidence is to recorded through video conferencing, one week prior notice be given to the Petitioners.

7. In view of the aforesaid, without going into the merits, nothing survives for further consideration in the aforesaid Petition and accordingly the Petition is disposed of.
8. We make it clear that, we have not gone into the merits of contentions of either of the parties against each other.
9. All concerned parties to act on the authenticated copy of this order.
