Section 13 in The Bombay Court of Wards Act, 1905

13. Assumption of superintendence to be notified and to extend to whole of Government ward's property.

(1)Whenever the Court of Wards assumes the superintendence of the property of any land-holder [or pension-holder] [These words were inserted by Section 4(1) of the Bombay Court of Wards (Amendment) Act, 1913 (Bombay 2 of 1913).] under this Act the fact of such assumption, and the (date on which it was sanctioned by the [ [State] [The words 'Provincial Government' were substituted for the words 'Governor in Council' by the Adaptation of Indian Laws Order in Council.] Government], shall be notified in the [Official Gazette] [The words 'Official Gazette' were substituted for the words 'Bombay Government Gazette' by the Adaptation of Indian Laws Order in Council.] and in such other manner as the [ [State] [The words 'Provincial Government' were substituted for the words 'Governor in Council' by the Adaptation of Indian Laws Order in Council.] Government] may, by general or special order, direct.
(2)On and with effect from the date of such sanction, the whole of the property, moveable and immovable, of such land holder [or pension-holder] [These words were inserted by Section 4(1) of the Bombay Court of Wards (Amendment) Act, 1913 (Bombay 2 of 1913).], whether the existence of any such property is known to the Court of Wards or not, shall be deemed to be under the superintendence of the Court of Wards.
(3)Any property which the Government ward may, inherit or acquire by succession subsequently to the date of such sanction shall also be deemed to be under the superintendence of the Court of Wards.
(4)The Court of Wards may, in its discretion, assume, or refrain from assuming, the superintendence of any property which the Government ward may acquire otherwise than by inheritance or succession subsequently to the date of such notification.
