(2 of 2) [CW-14792/2019] The petitioner has prayed to direct the respondents to divide the Gram Panchayat Abhaneri into two Gram Panchayats.

Demarcation of Gram Panchayats and allotting particular villages to a Gram Panchayat is an administrative power of the State Government wherein no judicial review is required and no rights of any person are either taken away or granted on account of formation or division of Gram Panchayats. Gram Panchayats should constiute under Article 243 C of the constitution of India in terms of the State Government Policies.

In view thereof, the writ petition under Article 226 of the Constitution of India would not lie for the prayer as made above.

The writ petition is found to be wholly frivolous and the same is accordingly dismissed.
