Order 26/09/2018 Heard learned counsel for the parties. Admit.
Heard on stay.
Having regard to the facts and circumstances of the case, impugned judgment dated 31st of January, 2018 passed by District Judge, Merta shall remain in abeyance subject to the condition that appellant RSMM shall furnish cumulatively a bank guarantee worth Rs.60 lakhs before the learned executing Court within a period of one week. The stay of impugned judgment shall also facilitate release of the bank account of the appellant seized by the executing Court.
It is made clear that learned counsel for the respondent shall be at liberty to apply for modification/vacation of the interim order, if occasion so arises.
