This is a petition for grant of pre-arrest bail in a case registered vide FIR No.42 dated 29.01.2009, under Sections 457, 380, 511, 427 IPC at Police Station Sadar, Amritsar.

Learned counsel for the petitioner submits that the petitioner was present in the Court on 05.07.2011 but his presence was not marked as a result of which he was shown to be absent and his presence was ordered to be secured through non-bailable warrants. Being afraid of his arrest, the petitioner had applied for pre-arrest bail before the learned Court of Sessions but his application has been dismissed with the observation that the petitioner would surrender before the learned Trial Court and explain the facts and circumstances resulting into recording of his absence from the Court. It was also observed that if the petitioner surrenders before the learned Trial Court within 5 days and moves an application for grant of regular bail, the same shall be decided within a week. Learned counsel for the petitioner submits that the petitioner would surrender before the learned Trial Court, but his regular bail application, if so filed, may be ordered to be decided on the same day.

After hearing learned counsel for the petitioner and taking into consideration the facts and circumstances of the case, the present petition is disposed of with a direction to the petitioner to surrender before the learned Trial Court and his application for grant of regular bail, if so filed, shall be decided by the learned Trial Court on the same day.
