01. 1. Heard learned counsels for the Petitioner and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s. 379/411/413/34, I.P.C. in connection with Chandbali P.S. Case No.196 of 2023 corresponding to G.R. Case No.485 of 2023 pending in the court of the learned J.M.F.C., Chandbali.

As reveals from the F.I.R. on 28.06.2023 at about 5.00 A.M. while the informant was performing patrolling duty, got information that one white coloured Pick-up van was unloading stolen coal on the land of one Pacha @ Debasish Rout of Motto. After getting such information, when the police team rushed to the spot, seeing the police the culprits fled away from the spot leaving the coal there. On search, the police found and seized 100 nos. of coal bags from the spot in presence of witnesses. On query, it was ascertained that one Gangadhar (the present Petitioner) had kept such stolen coal for selling purpose.

Having regard to the nature of the allegations against the Petitioner, gravity of the offences, the facts and circumstances of the case and above all the Petitioner is a habitual offender; this Court is not inclined to grant anticipatory bail in favour of the Petitioner. Accordingly, the prayer for bail stands rejected and the ABLAPL is dismissed.
