ORAL ORDER
3 25-11-2025Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner is apprehending his arrest in connection with Jakkanpur P.S. Case No. 401 of 2025, registered for the offence punishable under Sections 30(a)/37/38 of Bihar Prohibition and Excise Act and Sections 25(1- B)a/26/35 of Arms Act.

As per prosecution-case, the patrolling party raided OYO Hotel and in course of search 15 to 16 persons were found in standing position and bottles of Beer were kept under the table and 10-15 glasses were filled with wine. When asked about the wine, the accused persons replied that they were eating and drinking on the occasion of birthday of co-accused Patna High Court CR. MISC. No.66810 of 2025(3) dt.25-11-2025 2/3 Yuvraj Kumar. On search, 06.350 litre foreign liquor and a country-made pistol and magazine concealed beneath the mattress were recovered. After unloading the magazine, four live cartridges were recovered. When query was made about the firearm, it was disclosed by Yuvraj Kumar that arms and ammunition was brought by co-accused Mohit Raj and Divyanshu Sinha. When Divyanshu Sinha was interrogated, he disclosed that he had purchased the pistol in Rs.35,000/- from Pankaj Kumar and the petitioner.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence as alleged in the F.I.R. He was not found at the place of occurrence. It is orally submitted that the name of the petitioner was disclosed by co-accused Divyanshu Sinha. Except disclosure of co-accused Divyanshu Sinha, there is nothing to connect the petitioner with the alleged recovery of one country- made pistol. They were recovered from OYO Hotel from which petitioner has no concern. The petitioner is only alleged to have provided pistol to co-accused Divyanshu Sinha. Petitioner is having no criminal antecedent.
5. Learned A.P.P. vehemently opposes the prayer of anticipatory bail of the petitioner and submits that petitioner is Patna High Court CR. MISC. No.66810 of 2025(3) dt.25-11-2025 3/3 an F.I.R. named accused as his name surfaced on the basis disclosure made by co-accused Divyanshu Sinha and he cannot escape from the allegation made in the F.I.R. Hence, petitioner does not deserve anticipatory bail.

Considering the facts and circumstances of the case, nothing was recovered from his conscious possession, clean antecedent of the petitioner, arguments advanced on behalf of both sides and also taking into consideration the material available on record, let the petitioner above named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-02, Patna in connection with Jakkanpur P.S. Case No. 401 of 2025, Patna, subject to the conditions as laid down under Section-482(2) of B.N.S.S.
7. The application stands allowed.
