O R D E R (ORAL)

The present C.P. alleges willful disobedience of the interim Order passed by this Tribunal on 01.06.2022 in O.A. No. 1211/2021.
2. During the course of hearing, while considering the prayer for interim relief, we had passed the following directions :-
"Accordingly, in the facts and circumstances of the case, without examining or commenting upon the merits of the claim of the applicants and strictly driven by the specific and peculiar circumstances of the applicants, we give an interim direction to the respondent No.1 not to engage any other person for the various multifarious tasks, performed by Group 'D' staff including the works which were being performed by the applicants, as long as any of the applicants in the present OA are available for such engagement. It is only on the refusal of one or all of these applicants that the respondent No.1 shall have the liberty to engage some other contractual/casual staff. In other words, if any recruitment/ engagement is done, the present applicants would have the first right."
3. Learned counsel for the applicants argues that contrary to the directions issued by this Tribunal the 16 Item No. 01 C.P. No. 284/2022 In O.A. No. 1211/2021 respondents have issued an advertisement for engagement/appointment of workers of various categories thus jeopardizing the engagement of the applicants. He further alleges that the respondents are forcing the applicants to file an affidavit to the effect that they shall be withdrawing the aforesaid O.A. and only on the condition of such withdrawal will they be appointed/engaged. He further argues that the respondents are changing the eligibility criteria for appointment of workmen in various categories which would render the present applicants ineligible.
4. Learned counsel for the respondents, on the other hand, under instructions, vehemently contests the averments made by the learned counsel for the applicants and submits that the factual position is otherwise.
5. She makes a categorical statement, under instructions, that all the applicants have been engaged by the respondents and have been working as such since then. She further submits that there is no proposal to replace them with any new appointments. She also informs that the eligibility criteria set out in the advertisement is not applicable on the present applicants and their engagement continues undisturbed.

6. Such facts are not disputed. Accordingly, in view of the statement made by the learned counsel for the respondents we are of the view that nothing sustains in the present C.P. The same is accordingly closed.
No costs.
