In response to the public interest litigation. StL R Devdas, had been filed before the Karnataka: Appellate' Teibsarial b respondent no.4 in these proceedings. It was alleged before the Karnataka Appellate Tribunal "by the 'appellant, that the proceedings before the ASsistémt Commissioner had culminated with out effective hearing to the appellant Yn asmuch as his father had already died. Acéordingly: the Karnataka Appellate Tribunal has "remanded "the ; nat ler to the Assistant Commissioner... The grayamen of the dispute is that respondent peut nos.4 and @ have ilegaltly. blocked the public pathway. Since the matter has io be heard by the Assistant Cormmissioner, we i permit the petitioners (o participate in those proceedings, so .. that the said afficer can come to an appropriate conclusion.
