% 10.09.2020 Hearing has been conducted through Video Conferencing. Present petition has been filed by the Cabin Crew of Air India Limited.

Mr. Atul Kharbanada learned counsel for the Petitioners points out that pursuant to an Advertisement published on 11.06.2019 on the website of Respondent No. 2/Air India Limited, applications were invited for the posts of Cabin Crew.

Petitioners herein had applied pursuant to the said Advertisement and after due process of selection and medical clearance, offer letters were issued to them on 14.11.2019. It was categorically stated in the letters that the Petitioners were selected for the post of cabin crew on fixed term Agreements which will enable them to fly on Air India flights, after successful completion of training.

After completion of necessary formalities, Petitioners were informed that their training for the post of cabin crew shall commence from 16.12.2019 at Hyderabad and will be for a period of three months. However, on 15.03.2020 Petitioners were sent on leave by Respondent No. 2 and the training could not be completed.

No progress took place thereafter as far as training was concerned, on account of the outbreak of Pandemic COVID-19 and now the Petitioners have received letters dated 10.07.2020, intimating discontinuation of their services, with immediate effect.

Learned counsel submits that the cabin crew of the Western Region, which is similarly placed as the Petitioners herein, who are employees of the Northern Region, had filed a petition before the Bombay High Court being W.P. (C) No. 5715/2020 titled as Ifran Abdulla Malim & Ors. vs. Union of India assailing the discontinuation of their services. Bombay High Court vide order dated 24.08.2020 has issued notice, returnable after four weeks.

Counter Affidavits be filed within a period of three weeks. Rejoinder(s), if any, be filed within a period of one week thereafter.
