Section 18 in Tamil Nadu Town Panchayats (Establishment) Rules, 1988
18. Promotion to Selection and Non-Selection post. - (a) Promotion to selection posts shall be made on grounds of qualifications and merits, seniority being considered only where the qualifications and merits are approximately equal.
(b)Promotion to non-selection posts shall be made in accordance with strict seniority except: -(i)Where a senior does not possess the qualifications prescribed for holding the higher posts or is definitely proved to be incompetent to hold such post; or(ii)Where on account of his proved serious misconduct it is considered undersirable to promote him.
