Mr. A. S. Gill, learned Deputy Advocate General, Mr. Milind Raj, Mr. S. S. Adhikari, Mr. V. S. Rathour, Mr. Rakesh Kunwar, Ms. Farida Siddiqui and Mr. V. S. Mahra, Brief Holders, present for the State/respondents no.1 & 2. An FIR has been lodged against the petitioners registered as Case Crime No.298 of 2016 for the offences punishable under Sections 418, 420, 467, 468, 120-B, 504 and 506 of IPC, at Police Station Civil Line Roorkee, District Haridwar. After arguing the writ petition at some length, learned counsel for the petitioners confined his prayer only to the extent that some time may be given to the petitioners to surrender before the Magistrate concerned and, thereafter, court below be directed to decide the bail application of the petitioners at an early date.
Considering the facts of the case, four weeks' time is granted to the petitioners to surrender before the Magistrate concerned. No coercive measures shall be taken against the petitioners for a period of four weeks from today.
If the petitioners surrender before the Magistrate concerned well within time and seek bail, it is provided that their bail application(s) shall be decided at an early date without inordinate delay.
Writ petition stands disposed of with the direction as above.
In the given facts and circumstances of the present writ petition, this Court does not feel it necessary to issue notice to the private respondent. Still, liberty is granted to her to move for recall of this Order, if she feels aggrieved with the same.
