(1)If the State Government are of the opinion that for the purpose of preventing any tincture being used for the purpose of producing a state of intoxication it is necessary to regulate the sale thereof, it may, by notification declare such tincture to be a regulated tincture and thereupon no dealer shall sell or otherwise dispose of any quantity of such tincture except-(a)as an ingredient of a prescription given by a registered medical practitioner; or(b)upon a certificate given by a registered medical practitioner to the effect that the purchase of the tincture in the quantity specified in the certificate is necessary for bona fide medicinal purposes.
