1. Mr. Parag Tripathi, learned Senior Counsel for the respondent- National Highway Authority of India ["NHAI"], seeks some time to take instructions on the contents of the contempt petition [CCP(O) 43/2022].

2. Dr. Amit George, learned counsel for the petitioner, submits that the NHAI in I.A. 10733/2022 has suppressed a communication dated 07.07.2022 by which the letter annexed to the application (Annexure A-1) was withdrawn. Mr. Tripathi will take instructions on this aspect as well.

3. Dr. George further states that the petitioner has invoked the arbitration clause contained in the contract. Mr. Tripathi will also make his submissions as to whether the matter may be referred to arbitration in the course of these proceedings.

4. As far as the contempt petition is concerned, Mr. Tripathi relies upon a corrigendum dated 12.07.2022, which is taken on record. He states that the impugned tender process will be kept in abeyance until the next date of hearing before this Court.
