172. Supply of water to connected premises.
(1)The Chief Municipal Executive Officer/ Municipal Executive Officer may, on an application by the owner, lessee or occupier or any building, either on his own or through any other agency, arrange for supply of water from the nearest main to such building for domestic purposes in such quantity as may be deemed to be reasonable and may, at any time., limit the quantity of water to be supplied whenever considered necessary:Provided that the Chief Municipal Executive Officer/ Municipal Executive Officer may, by order in writing, delegate the responsibility of receiving the application to any other agency.(2)For the water supplied under sub-section (1), payment shall be made at such rate as may be fixed by the Municipal from time to time:Provided that such rate shall, as far as practicable, cover the costs on account of management, operation, maintenance, depreciation, debt servicing, and other charges related to waterworks and distribution costs, including distribution-losses, if any.(3)A supply of water for domestic purposes shall be deemed not to include a supply-(a)to any institutional building, assembly building, business building, mercantile building, industrial building, storage building, or hazardous building, referred to in clause (2) of section 339, or any part of such building, other than that used as a residential building, or educational building, within the meaning of sub-clause (a), or sub-clause (b), of clause (2) of that section,(b)for building purposes,(c)for watering roads and paths,(d)for purposes of irrigation,(e)for gardens, fountains, swimming pools, or for any ornamental or mechanical purpose, or(f)for animals or for washing vehicles where such animals or vehicles are kept for sale or hire.
