This is an appeal filed by the assessee against the order of Commissioner of Income Tax-3, Kolkata for the assessment year 2011-12, in the matter of order passed u/s 263 of the Income Tax Act, 1961 vide his order dated 25.01.2016.
Shri Samit Kumar Jena, Ld. Authorized Representative appeared on behalf of assessee and Shri R.S. Biswas, Ld. Departmental Representative represented on behalf of Revenue.
2. At the outset, Ld. counsel for the assessee filed an application dated 13.02.2017 wished to seek permission for withdrawal of the appeal and Ld. DR has not objected ITA No.467/Kol/2016 A.Y. 2011-12 M/s Jagdamba Inds. Ltd. Vs. CIT-3, Kol Page 2 the withdrawal of the same. As there is no objection from the Revenue, we permit the withdrawal of assessee's appeal. Accordingly, this appeal of assessee is dismissed as withdrawn.
3. In the result, assessee's appeal stands dismissed as withdrawn.
