Petitioner is aggrieved by order of transfer dated 15.7.2021 whereby he has been sent from Jaunpur to Gorakhpur. His transfer is allegedly in public interest. The order of transfer, however, is assailed on the ground that the petitioner is due to retire in September, 2022 and, therefore, by virtue of transfer policy petitioner ought to be posted at a place of his choice. Various other personal difficulties are pointed out. It is, therefore, asserted that the transfer order is in teeth of the policy itself and hence, is unsustainable.
Learned Standing Counsel submits that such facts can be examined by the Engineer-in-Chief, at the first instance.
In the facts and circumstances of the case, it would be appropriate to permit the petitioner to represent his grievance before the respondent no. 2 , annexing therewith all materials in support of his claim alongwith copy of this order within a period of two weeks from today. Such representation of the petitioner shall be dealt with in accordance with transfer policy, within a further period of six weeks, thereafter. In the event petitioner has not been relieved so far, he shall not be relieved till disposal of his representation.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
