Section 8 in Uttar Pradesh Municipal Corporation Act, 1959

8. [ Duration of Corporation. [Substituted by U.P. Act 12 of 1994 (w.e.f. 30-5-1994).]

(1)A Corporation, unless sooner dissolved under Section 538, shall continue for five years from the date appointed for its first meeting and no longer.
(2)An election to constitute a Corporation shall be completed -
(a)before the expiry of its duration specified in sub-section (1);
(b)before the expiration of a period of six months from the date of its dissolution under Section 538 :
Provided that where the remainder of the period for which the dissolved Corporation would have continued is less than six months, it shall not be necessary top hold any election for constituting the Corporation for such period.
(3)A Corporation constituted upon its dissolution before the expiration of its duration shall continue only for the remainder of the period for which the dissolved Corporation would have continued under sub-section (1), had it not been so dissolved.
(4)[ Notwithstanding anything to the contrary contained in any other provisions of this Act, where due to unavoidable circumstances or in the public interest, it is not practicable to hold an election to constitute a Municipal Corporation before the expiration of its duration, then until the due constitution of such Municipal Corporation, all powers, functions and duties of the Corporation, its Mayor, [Deputy Mayor], Wards Committee, Executive Committee, Development Committee and other Committees established under clause (e) of Section 5 shall as from the specified date, be vested in and be exercised, performed and discharged by District Magistrate who shall be called the Administrator and such Administrator shall be deemed in law to be the Corporation, the Mayor, the [Deputy Mayor] [The word 'Deputy Mayor' omitted by U.P.
