Background
1. The Appellant filed an RTI request dt.13.3.08 with the CPIO, Dept. of Posts, Almora. He requested for information against 8 points regarding a registered letter which was not delivered to him. The CPIO replied on 25.3.08 providing point wise information. Not satisfied with the reply, the Appellant filed an appeal dt.30.4.08 with the Appellate Authority. The Appellate Authority replied on June 2008. The Appellant then filed a second appeal dt.25.8.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing on January 14, 2009.
3. Mr. B.D Lohani represented the Public Authority.
4. The Appellant was not present during the hearing.
Decision
5. The Respondent submitted that although the Appellant was at home, he did not accept the Registered letter since he probably feared that it could be a matter related to some disciplinary action being taken against him. However, later he filed an RTI application requesting for information about the same Registered letter. The Respondent also submitted that as per rules once the letter is not accepted, it is returned to the sender by the next mail and that this letter was also returned to the Appellant the day after he had refused to accept it.
6. The Respondent submitted a rejoinder to the 2nd appeal dt. 14.1.09 to the Commission during the hearing.
7 The Commission noted that all the information has already been provided and directs the CPIO to also send a copy of the rejoinder to the Appellant within 5 days of the receipt of this Order.
8. The appeal is disposed off.
