the date on which they had been promoted or got financial upgradation to the pay scale of Sr. Chargeman under ACP scheme with interest at the rate of 18 per cent per annum.82 OA No. 543/2025
2 Facts in brief are that on 01st January, 1996 or, thereafter, the applicants were working as Sr. Chargeman w.e.f. 01st January, 1996 or later when they were promoted to the post of Sr. Chargeman. The post of Sr. Chargeman carries pay scale of Rs.5,500-9,000. The post of Chargeman/Sr. Chargeman belongs to technical cadre. It is their contention that due to certain anomalous situation having arisen at the time of implementation of 5 th Pay Commission, OA No.180/01149 of 2014 was filed in Central Administrative Tribunal, Ernakulam Bench which was dismissed. OP (CAT) 271/2016 and 213/2017 were filed in Kerala High Court challenging the decision in OA No.180/2016. Kerala High Court held thus :-

3. The Competent Authority considered the entire issue and passed the order on 16th October, 2018, thereby, pay scale of Sr. Chargeman at Naval Ship Repair Yard Kochi was revised from Rs.5,000-8,000/- to Rs. 5,500-9,000/-
w.e.f. 01st January, 1996. They contend that they are similarly placed to the persons working as Sr. Chargeman at Naval Ship Yard Kochi as they too were working as Sr. Chargeman but in Naval Dock Yard Mumbai. The applicant further contends that several employees working as Sr. Chargeman approached the Tribunals from time to time and only then the benefits of pay scale of Rs.5,500-9,000/-
w.e.f. 01st January, 1996 has been extended to them. In short, the respondents rejected the representation of the applicant only on the ground that the judgment of Kerala High Court is personam and not in rem. (b) This Hon'ble Tribunal may be pleased to Order and direct the Respondents to grant pay scale of Rs.5500-9000/- w.e.f. 01st January, 1996 or on any other date when the Applicants assumed the charge of Sr. Chargeman or got financial upgradation to the pay scale of Senior Chargeman under ACP Scheme with all consequential benefits i.e. pay fixation, Pension and Other Retiral Dues Fixation, arrears of pay and Arrears of Pension and other retiral dues with 18% interest thereon.

Respondents filed their written statement contending therein that out of 250 applicants, only 3 applicants have 85 OA No. 543/2025 made representations immediately after the decision of the courts, wherein, similar relief has been granted to the applicants. In the case of State of Karnataka & Ors Vs. S. M. Kotrayya & Ors 1996 (6) SCC 267, it has been held that delay application filed immediately after coming to know, in similar claim, relief has been granted, that is not a proper explanation to justify condonation of delay.
5. They further contend that Naval Armament Organization in Indian Navy has two wings of Technical Supervisors i.e. Factory Wing and Ammunition Workshop (AWS) Wing. They had promulgated revised pay scale, in respect of technical supervisors of Indian Navy w.e.f. 01st January, 1996, based on recommendation of 5th CPC. They have shown the pay scale in tabular form as reproduced here under:-

They further contend that granting of different pay scales to Sr. Chargeman of Factory and Ammunition Workshop Wings (AWS) i.e. Rs.5000-150-8000 and Rs.5500-175-9000 respectively, led to an anomaly among staff. Therefore, the said anomaly was placed before anomaly committee which has identified the anomaly and confirmed that granting pay scale of Rs.5500-175-9000 to erstwhile Sr. Chargeman of AWS was due to misconception of factual position. They contend that the applicants have approached the Tribunal after the delay of more than 29 years and, therefore, they are not entitled to any benefit of the judgment of Kerala High Court.87 OA No. 543/2025
7. We have heard learned counsel for the applicant and learned counsel for the respondents.
8. Learned counsel for the applicant submitted that the respondents have granted the benefits only to those persons who have approached the Tribunal and the Tribunal has passed the orders. He further contended that the respondents had not disputed that the applicants are similarly situated with the petitioners in the case decided by the Kerala High Court. When the applicants are similarly situated, the question of limitation does not arise when the judgment is in rem. In the case at hand, this Tribunal has held that the judgment is in rem and, therefore, the question of limitation in such cases does not arise.Digitally signed by Abhishek

9. Learned counsel for the respondents vehemently submitted that the applicant has not filed application for condonation of delay. As per Section 21 of the Administrative Tribunals Act, the applicant has to file application for condonation of delay, if, Original Application is not filed within one year from the date of arising of cause 88 OA No. 543/2025 of action. In the case at hand, the cause of action had arisen in 1996 itself. Therefore, there is delay of 29 years.
For this purpose, he has placed reliance on the case of State of Karnataka & Ors. Vs. S. M. Kotrayya & Ors (supra).
10. In reply, learned counsel has placed reliance on the case of Lt. Col. Suprita Chandel Vs. Union of India and Ors. 2024 SCC Online SC 3664 and judgment of this Tribunal dated 17th December, 2025 in OA No. 229/2025 Rajendra Ananda Waghmare and Ors Vs. Union of India and Ors.
11. We have given thoughtful consideration to the submissions made by the learned counsel for the respective Digitally signed by Abhishek parties. When the applicants are similarly situated with the petitioners in the judgment in Kerala High Court, as a model employer, the respondents ought to have extended the same benefit to the applicants. Kerala High Court had held in the case of M. K. S. Pillai & Ors Vs. UOI & Ors in 89 OA No. 543/2025 WP No.30853/2003 (S) that those employees who were working as Sr. Chargeman are entitled to pay scale of Rs.5,500-9,000/- as they were declared to be entitled to that pay scale. From the pleadings of the respondents, it is clear that they are not disputing this position. The only objection raised by them is that the applicants have not filed application for condonation of delay.
12. In the case of Lt. Col Suprita Chandel Vs. Union of India & Ors. (2024) SCC Online SC 3664, in para 10, 11 and 14, Hon'ble Supreme Court has held thus:-
"10. At the outset itself, we may say that the phrase "Only to the Petitioners" in the order rejecting the representation is patently erroneous. While the AFT Principal Bench granted relief to the petitioners, it did not prohibit the department from considering similarly situated persons. The appellant thereafter filed Original Application No. 241 of 2021 before the AFT, Regional Bench, Lucknow seeking relief similar to the ones granted to the batch of petitioners in O.A. 111 of 2013 by AFT, Principal Bench, New Delhi which attained finality. For the sake of completion of record, it should be mentioned 90 OA No. 543/2025 that the appellant had in 2014 itself moved to the Armed Forces Tribunal by filing an application in Diary No. 1761 of 2014.
However, the said application was withdrawn with liberty to move afresh. Thereafter, again she filed O.A. 70 of 2017 before the Principal Bench which was again withdrawn with liberty to move the appropriate Tribunal. It was thereafter that after making the representation on 4th October 2017 which was rejected on 09.11.2017 and after returning from the Arunachal Pradesh posting and further after the Covid-19 ordeal had reasonably subsided in January, 2021, she moved the AFT, Regional Bench, Lucknow by filing O.A. No. 241 of 2021, which has been dismissed by the impugned order.
14. It is a well settled principle of law that where a citizen aggrieved by an action of the government department has approached the court and obtained a declaration of law in his/her favour, others similarly situated ought to be extended the benefit without the need for them to go to court. [See Amrit Lal Berry v. Collector of Central Excise, New Delhi, (1975) 4 SCC 714]"

Rather, from the judgment of the Kerala High Court, it can be deducted that it was for the post of Sr. Chargeman.
When the pay scale is fixed for a particular post, it is a judgment in rem. Therefore, in terms of judgment of 91 OA No. 543/2025 Supreme court in the case of Lt. Col. Suprita Chandel (supra), the respondents ought to have extended the same benefit to the applicants.
14. This takes us to the question of limitation.
15. So far as, question of limitation is concerned as held in the case of State of Uttar Pradesh & Ors Vs. Arvind Kumar Srivastava & Ors (2015) 1 SCC 347 decided on 17th October, 2014. If judgment is in rem, the question of limitation goes on the back burner. This is what Hon'ble Supreme Court has held in the case of Arvind Kumar Srivastava (Supra).
16. In view of this, it is clear that when the judgment is in rem, the question of limitation loses its significance.

17. It is true that the applicant has not filed application for condonation of delay. The question is whether application for condonation of delay is necessary in the case where the judgment relied upon is judgment in rem.
The answer has to be only negative. The only thing is that the applicants in their OA must explain as to how they are 92 OA No. 543/2025 similarly situated and that the judgment they are relying upon is judgment in rem. For this purpose, the OA has to be read as a whole. In the case of Indian Evangelical Lutheran Church Trust Association Vs. Sri Bala & Co.
Civil Appeal No.1525 of 2023, it has been held as under:-
"6.1
(viii) In Biswanath Banik vs. Sulanga Bose, (2022) 7 SCC 731, this Court discussed the issue whether the suit can be said to be barred by limitation or not, and observed that at this stage, what is required to be considered is the averments in the plaint. Only in a case where on the face of it, it is seen that the suit is barred by limitation, then and then only a plaint can be rejected under Order VII Rule 11(d) of the Code on the ground of limitation. At this stage what is required to be considered is the averments in the plaint. For the aforesaid purpose, the Court has to consider and read the averments in the plaint as a whole.
18. From the judgment of Hon'ble Supreme Court, it is clear that for ascertaining the issue of limitation, Digitally signed by Abhishek plaint/pleading has to be read as a whole. 19. Learned counsel for the respondents has placed reliance on the case of State of Karnataka & Ors Vs. S. 93 OA No. 543/2025 M. Kotrayya (supra). In this case Hon'ble Supreme Court has held thus:-
"A reading of the said section would indicate that sub-section (1) of Section 21 provides for limitation for redressal of the grievances in clauses (a) and (b) and specifies the period of one year. Sub-section (2) amplifies the limitation of one year in respect of grievances covered under clauses (a) and (b) and an outer limit of six months in respect of grievances covered by sub-section (2) is provided. Sub-section (3) postulates that notwithstanding anything contained in sub- section (1) or sub-section (2), if the applicants satisfy the Tribunal that. they had sufficient cause for not making the applications within such period enumerated in sub-sections (1) and (2) from the date of application the Tribunal has been given power to condone the delay, on satisfying itself that the applicants have satisfactorily explained the delay in filing the applications for redressal of their grievances. They are entitled, as a matter of right, to invoke the jurisdiction of the Court for redressal of their grievance. If the applications come to be filed beyond that period, then the need to give satisfactory explanation for the delay caused till date of filing of the application must be given and then the question of satisfaction of the Tribunal in that behalf would arise. section (3) starts with a non obstante clause which rubs out the effect of sub-section (2) of Section 21 and the need thereby arises to give satisfactory explanation for the delay which occasioned after the expiry of the period prescribed in sub-sections (1) and (2) thereof."
20. This case has no application to the facts of the case at hand. In this case, facts were that the respondents availed LTC but never travelled and simply used the amount.
Recovery was made by government. It was challenged before the Tribunal. Tribunal allowed the OA. Respondents (employees) had not filed application for condoning the delay. On this background, aforesaid observations were made. There was no question of applicants being similarly situated. In this view of the matter, we do not find any force in the contention of the respondents.

21. In view of the above, Original Application is allowed.
The applicants are declared to be entitled to the pay scale of Rs.5,500-9,000/- w.e.f. the date they took charge of the post of Sr. Chargeman or under ACP Scheme. The respondents to grant pay scale of Rs.5,500-9,000/-. The applicants are declared entitled to pay scale of Rs.5,500- 95 OA No. 543/2025 9,000/- from 01st January, 1996 or thereafter three months from the date of judgment of Kerala High Court in the case of M. K. S. Pillai (supra). This shall be done within a period of three months from the date of receipt of certified copy of this order. Pending MAs, if any, stand closed. No order as to costs.
