                                       ORDER

1. As per order dated 08.06.2021, this Tribunal had considered the status report submitted by the Tamil Nadu Pollution Control Board signed on 27.01.2021 e-filed on 01.02.2021 and received on 15.04.2021 and extracted the same in para 8 of the order and also considered another report submitted by Tamil Nadu Pollution Control Board dated 01.04.2021 e-filed on 02.04.2021 and received on 12.04.2021which was extracted in para 9 of the order and thereafter, passed the following order:

10.The Pollution Control Board also produced the action plan on rejuvenation of river Thirumanimutharu from Salem to Papparapatti village stretch which is identified as priority one polluted river stretch which shows that some work has been done.
11.It is also seen from the report that there are certain directions issued by the Principal Bench of National Green Tribunal, New Delhi in respect of polluted river stretches in O.A. No.673 of 2018 and on that basis, certain schemes have been framed and that is being implemented by them.
12.It is also mentioned in the report that the action plan was approved by the Central Pollution Control Board with certain directions which was extracted in Para 7 of the report submitted by the Pollution Control Board which was extracted above.
13.But they have not mentioned as to what is the present status of the work done and what is the remaining work to be done and whether the action taken against the industrial units had resulted any improvement in the water quality etc.
14.Even the report submitted by the Pollution Control Board shows that only certain percentage of houses have been connected to the underground sewage system and certain STPs were put under operation.
15.It is seen from the reports that certain unit against whom action has been taken has filed appeals before the Pollution Control Board Appellate Authority and the appeals are pending. But they have not mentioned as to whether those appeals have been disposed of or not in the subsequent reports filed.
16.So under such circumstances, we direct the Tamil Nadu Pollution Control Board, Central Pollution Control Board, Salem City Municipal Corporation to file further status report regarding the progress of the work and how much time it will take for completion of the underground sewage system and operation of STP so as to ensure that no untreated sewage water generated in Salem City Municipal Corporation is discharged into the Thirumanimutharu River which is the major source of pollution to the river water.
17.The Tamil Nadu Pollution Control Board is also directed to submit a status report regarding the operation of the units which were found to be discharging untreated effluents into the river and whether the ZLD systems have been established and if so, whether the STP/ETP that is being established in those units are functioning in accordance with the norms provided and collect samples of effluents are discharged from the ETP/STP in the industrial units from the inlet and outlet and how the treated effluent/sewage is being utilized by them to minimize the discharge of same into the river so as to avoid pollution being caused to the river.
18.The Central Pollution Control Board is directed to file a detailed report regarding the implementation of the directions issued by the Principal Bench of National Green Tribunal in the polluted river stretches case mentioned above.
19.They are directed to submit their respective reports to this Tribunal on or before 27.07.2021 by e-filing in the form of Searchable PDF/OCR Supportable PDF and not in the form of Image PDF along with necessary hardcopies to be produced as per Rules.
20.The Registry is directed to communicate this order to the Tamil Nadu Pollution Control Board, Central Pollution Control Board, Regional Office, Chennai and also to the Salem City Municipal Corporation by email immediately so as to enable them to comply with the direction.

The case was posted to today for consideration of further reports.

2. When the matter came up for hearing today through Video Conference, there was no representation on behalf of the applicant. Mr. C. Kasirajan through Ms. Ashwini represented respondents 1 and 3, Dr. D. Shanmuganathan represented respondents 2, 4 and 5, Mr. S. Sathish represented 7th respondent and Ms. Nathami represented CPCB.

3. We have received a status report submitted by Central Pollution Control Board dated 23.07.2021, e-filed on 26.07.2021 and received today which reads as follows:

STATUS REPORT IN THE MATTER OF OA NO. 51/2015 AS PER ORDER DATED 08.06.2021 In the matter of OA no. 51/2015, Hon'ble Tribunal (SZ), Chennai vide order dt. 08.06.2021 directed as;
"... Central Pollution Control Board directed to file a detailed report regarding the implementation of the directions issued by the Principal Bench of National Green Tribunal in the polluted river stretches case mentioned above..."

1. In the matter of OA no. 673/2018 (PB) order dt. 08.04.2019 Constituted a Central Monitoring Committee to undertake a national initiative by way of preparation and enforcement of a national plan to make river stretches pollution free comprising a senior representative of NITI Aayog, Secretaries Ministry of Water Resources, Ministry of Urban Development, Ministry of Environment, Forest and Climate Change, Director General, National Mission for Clean Ganga and Chairman CPCB. Chairman CPCB will be the nodal authority for coordination. Senior most among them will preside over the deliberations. The Central Monitoring Committee will also coordinate with the RRCs of the States and oversee the execution of the action plans, taking into account the timelines, budgetary mechanism and other factors. Chief Secretaries of States will be the nodal agency at State level. The Chief Secretaries of the States may undertake review of progress of RRCs by involving concerned Secretaries of Department of Urban Development, Environment, Industries, Irrigation and Public Health, Health etc.

2. National Mission for Clean Ganga (NMCG), Ministry of Jal Shakti, GOI is periodically reviewing the progress of all polluted river stretches in all the states and submitting the report to the Secretary, Ministry of Jal Shakti and being further reviewed by Central Monitoring Committee. NMCG is obtaining monthly progress report in a prescribed format from Tamilnadu Pollution Control Board. The monthly progress report obtained from the States are being uploaded in NMCG website https://nmcg.nic.in/ngtprogressreport.aspx

3. NMCG is submitting the quarterly review report of Central Monitoring Committee to Hon'ble NGT (PB), Delhi and also uploading in their website https://nmcg.nic.in/ngtdetails.aspx?ngtmatid=113.

4. Since Ministry of Jal Shakti is reviewing the action plan of all polluted river stretches in the country under the Chairmanship of Secretary, MoJS, CPCB requested TNPCB to provide the status of implementation of action plan of River Thirumanimuthar. Accordingly, TNPCB has provided the copy of consolidated progress report & gist of the report for the month of May 2021 submitted to NMCG. The said report is attached as Annexure 1. The information on River Thirumanimuthar extracted from said progress report is as follows;

A Comprehensive Groundwater (Management and Development) Act, to regulate and manage the extraction of Groundwater is under active consideration of the Government of Tamil Nadu.

Name of the River Good irrigation practices being adopted by the State Sarabanga Thirumanimutharu Awareness meetings are conducted under TNIAMP, ADB & Vasista State Funds.In some parts of the reach DRIP irrigation is Cauvery Bhavani practiced.

Demarcation of Flood plain and removal of illegal encroachments - PWD:
Name of the River Demarcation of Floodplain and removal of illegal encroachments Sarabanga Drone Survey completed by WAPCOS in January 2021. The draft DPR at a cost of Rs.2.0 Cr prepared by WAPCOS for identification of flood plain zones and area for afforestation to maintain Bio Diversity has been submitted and is under the scrutiny of PWD. Encroachment if any is identified in the survey will be evicted and other management works will be completed by March 2022 after rehabilitation and resettlement.
Maintaining minimum e-flow of river - PWD: Name of the River Maintaining minimum e-flow of river Thirumanimutharu This river is only a flood carrier. The sewage water enters in to the river in Salem Corporation. Treatment plants have been proposed under NadanthaiVaazhi Cauvery for which a draft DPR has been prepared by M/s. WAPCOS, submitted and is under the scrutiny of PWD. E flow will be maintained in this river after completion of sewage treatment plants by March 2022, the treated water will flow as environmental flow.
Plantation activities along the rivers-PWD Name of the River Plantation activities along the Rivers Thirumanimutharu DPR is prepared and under scrutiny by PWD for planting 42,000 Nos. of treesaplings.
Development of biodiversity park - PWD Name of the River Development of Biodiversity park Sarabanga Drone Survey has been completed by M/s.WAPCOS in January 2021. A draft DPR prepared by M/s.WAPCOS has been submitted and is under scrutiny of PWD. This work will be completed in March 2022.
Gist of Report on the progress made on the Polluted River Stretches Tamil Nadu State Month : May 2021 Sl.. 2 Sewage Generation 3786.16 MLD in Tamil Nadu.
3.a. Existing STPs There are 71 STPs in operation with treatment capacity of 1634.154MLD and in 11 FSTPs -0.324 MLD is treated. In certain STPs 2.5 to 10.7% increase in utilization has been achieved during April 2021 (annexure-1).

b. Under construction 45 STPs (976.4 MLD capacity) and 41 FSTPs (1.045 MLD STPs capacity) are under construction and they are at various stages of implementation. In Under Construction projects of STPs, 1% to 40% increase has been achieved during May 2021and the details are furnished in annexure-2.

c. Proposed STPs: 37 STPs are proposed to fill the gap of treatment of sewage.


4 a.     Existing MSW               12,953 TPD of solid waste is generated in the State with treatment

d       Bio -mining                 Bio -mining is being taken up in 15 ULBs and Biomining Works

5 a.    Existing CETPs              There are 36 CETPs existing in the State with a capacity of 87350
                                     KLD. Out

of the 36 CETPs, 34 CETPs are in operation, 2 CETPs have been closed for non-compliance of Board orders. The details are submitted in annexure-4.

b. Proposed CETPs : Along the polluted river stretches, 10 CETPs of 41 MLD are proposed for dyeing units and they are under proposal stage.

6. Biomedical waste 25,910 health care units in the State generate 88.01 TPD of biomedical wastes, management for which 10 bio-medical waste treatment facilities are in operation, 7 Hazardous Waste Total haz. Waste generation is 9.64810lakhs ton per annum. Out of Management which re-

cyclable is 1.2081 lakhs ton/anum, utilizable is 7.30 lakhs ton/annum, land fillable is 0.9 lakhs ton/annum and incinerable is 0.24 lakhs tons/annum.

8 Coastal As per the directions in the NGT order dated 22nd September 2020, Man 46 Nos. of stretches have been identified in 14 districts as polluted agement Plan:

zones for which action plan is under preparation and it will be furnished by the Director of Environment, Govt. of Tamil Nadu early.

9 Water Quality in Polluted River Stretches: March 2021 10 Reuse of treated water 80.50 MLD of treated waste water is reused for agricultural and industrial purposes 11 Maintenance of ground and surface water quality - PWD a. Ground water quality: Along the polluted river stretches monitoring wells have been provided and the ground water is monitored. b. Ground water regulation: Ground water (Management and development) Act to regulate and manage the extraction of Ground water is under active consideration of the Government. c. Good irrigation practices adopted by the State: Village level awareness meetings are carried- out by the PWD to adopt crop rotation and good irrigation practices. Rehabilitation and modernization of tanks are carried-out by the PWD. d. Rain Water Harvesting: 91 existing RWH structures along the PRS are provided; 50 Nos. are under progress and 283 Nos. of recharging wells and check dams are proposed. e. Demarcation of flood plain zones and removal of encroachments: In the PRS for demarcation of flood plain zones and removal of encroachments drone surveys are proposed for which DPR is under preparation. f. E-flow: It will be maintained in the rivers of Sarabanga, Thirumanimutharu,Vasista after completion of STPs. In the rivers of Cauvery, Bhavani and Tamiraparani E- flow is being maintained.

-aru areas. The TDS in this stretch vary between 500 mg/l to 2000 mg/l.

Vasista The SG&SWRDC is having monitoring wells in Papanaickenpatti, Yethapur, Athur and Thalaivasal. The TDS value is between 336 mg/l to 1029 mg/l Cauvery The SG&SWRDC is having ground water quality data for the areas of Dharmapuri, Mettur, Bhavani, Salem, Paramathivelur, Kumarapalayam, Karur, Erode, Musiri, Trichy, Kulithalai, Kumbakonam and Mayiladuthurai and in Dharmapuri the TDS varies between 523 mg/l to 2096 mg/l, at Salem the water quality varies between 412 to 2845 mg/l, at Namakkal the TDS exceed even 6000 mg/l. At Thanjavur and Cuddalore in most of the locations the water quality is found to vary between good and moderate and at few places of Cuddalore the TDS varies between 5000 to 6000 mg/l .

Bhavani The general distribution of ground water quality varies between Good to moderate level. Especially Nilgiris is having good quality water. Thamirabarani The collected water quality data of Cheranmadevi, Thiruvidaimaruthur, Ambasamudram, Thirunelveli, Palayamkottai, and Ariyanaygipuram showed good, poor and moderate quality based on TDS.

XIV. Ground water regulation-PWD Name of the River Ground water regulation Sarabanga Thirumanimutharu For effective management of Ground Water, 683 packaged drinking water firms Vasista operated illegally have been closed as per Honorable Madras High Court order Cauvery passed under WP No.16299 / 2018. XV. Good irrigation practices being adopted by the State-PWD:

Name of the Good irrigation practices being adopted by the State River Sarabanga Awareness meetings are conducted under TNIAMP, ADB & State Funds. In Thirumanimutharu some parts of the reach DRIP irrigation is practiced.
Vasista Cauvery Bhavani Thamirabarani Village level awareness campaigns are conducted periodically by PWD officials to adopt the crop rotation for good irrigation practices. Rehabilitation and modernization of Tanks, Anicuts and Supply channels are being carried out in TNIAMP projectas per GO Ms No: 140 PW (WR 1) Dept Dt: 21.06.2017 for an amount of Rs.107.09 crores. Kudimaramath woks as per G.O (Ms).No.98PW(W1)Dept/Dt: 22.04.2020 for an amount of Rs. 16.365 Crores is carried out in Tirunelveli and Thoothukudi Districts.

Name of the River Demarcation of Floodplain and removal of illegal encroachments Sarabanga Drone Survey completed by WAPCOS in January 2021. The draft DPR at Thirumanimuth a cost of Rs.2.0 Cr prepared by WAPCOS for identification of flood plain a ru zones and area for afforestation to maintain Bio Diversity has been submitted and is under the scrutiny of PWD. Encroachment if any is identified in the survey will be evicted and other management works will be completed by March 2022 after rehabilitation and resettlement.
Vasista No Flood plains zones/encroachment have been identified. Cauvery Drone Survey completed by WAPCOS in January 2021. The draft DPR at a cost of Rs.20.0 Cr prepared by WAPCOS for identification of flood plain zones and area for afforestation to maintain Bio Diversity has been submitted and is under the scrutiny of PWD. Encroachment if any is identified in the survey will be evicted and other management works will be completed by March 2022 after rehabilitation and resettlement. Bhavani a.Drone Survey completed by WAPCOS in January 2021. The draft DPR at a cost of Rs. 2.0 Cr prepared by WAPCOS for identification of flood plain zones and area for afforestation to maintain Bio Diversity has been submitted and is under the scrutiny of PWD. b.55 Nos of encroachments are to be removed belong to fishing community. Recommendations for alternate land has been sent to Secretary to Government, Revenue department by Commissioner for Revenue administration vide letter No F.2/41632/2005/Dt.15.2.2006. Thamirabarani a. To prepare comprehensive flood protection plan for Thamirabarani River Rs.
4.00 Lakhs has been allotted vide GO Ms. No. 37 Revenue (DMII) Department 9.02.2017. Estimate has been prepared for Rs. 4.00 Lakhs for the demarcation of Flood plain zone and steps are being taken for the protection and management of Flood plain Zones of Thamirabarani .

b. In Tirunelveli Corporation, ProsopisJuliflora on the river stretches for a length of 10km from Vilagam to Naranammalpuram river bridge were removed at a cost of 140.00 lakhs vide GO(2D) No. 14 PW (P2) Dept Dated 8.03.2019 to restore the River course for a free flow of flood water. c. In River Banks of the Thamirabarani, the following encroachments were identified and demarcated by the water resources department/Public works department.

The issue of eviction notices to the encroachers under eviction of encroachment act is under progress in Tirunelveli and Thoothukudi districts. XI. Maintaining minimum e-flow of river-PWD:

Name of the Maintaining minimum e-flow of River river Sarabanga This river is only a flood carrier. The sewage water enters in to the river in Edapaddi Municipality, Omalur Town Panchayat and Poolampatti Town Panchayat. The above treatment plants are proposed under Nadanthai Vaazhi Cauvery for which a draft DPR has been prepared by M/s. WAPCOS, submitted and is under the scrutiny of PWD. E flow will be maintained in this river after completion sewage treatment plants by March 2022. The treated water will flow as environmental flow. Thirumanimut This river is only a flood carrier. The sewage water enters in to the h aru river in Salem Corporation. Treatment plants have been proposed under NadanthaiVaazhi Cauvery for which a draft DPR has been prepared by M/s. WAPCOS, submitted and is under the scrutiny of PWD. E flow will be maintained in this river after completion of sewage treatment plants by March 2022, the treated water will flow as environmental flow.
Vasista This river is only a flood carrier. But the sewage water enters in to the river in Attur and Narasingapuram Municipality. After completion of sewage treatment plants in the above locations, the treated water will flow as environment flow.
Cauvery Mettur dam is opened for irrigation from June 12th to January 28th based on availability of water every year. It is opened for drinking purpose in the remaining days. Usually a monthly minimum average E flow of 0.10 TMC is maintained. The E flow is maintained for more than 8 months. During the month of May 2021 an E Flow of 0.111 TMC was maintained.
Bhavani An E flow of 34,363 cusecs (including Irrigation purpose) was maintained in the river Bhavani during the Month of May 2021.
Thamirabarani An average of 316 cusecs of water is released into the river in the month of May 2021 to ensure minimum environmental flow.
XII. Plantation activities along the rivers-PWD Name of the River Plantation activities along the Rivers Sarabanga DPR is prepared and under scrutiny by PWD for planting 32,400 Nos. of tree saplings.
Thirumanimutharu DPR is prepared and under scrutiny by PWD for planting 42,000 Nos.
of tree saplings.
Vasista There is no proposal at present.
Cauvery DPR is prepared and under scrutiny by PWD for planting 1,44,500 Nos. of tree saplings.
Bhavani DPR is prepared and under scrutiny by PWD for planting 86,500 Nos.
of tree saplings.
Thamirabarani At present there is no proposal on plantation on the River Banks and investigation works are being taken to implement it by Forest Department.
XI. Development of biodiversity park - PWD Name of Development of Biodiversity park the River Sarabanga Drone Survey has been completed by M/s.WAPCOS in January 2021. A draft DPR prepared by M/s.WAPCOS has been submitted Thirumanimutharu and is under scrutiny of PWD. This work will be completed in March 2022.
Vasista There is no proposal at present.
Cauvery Drone Survey has been completed by M/s.WAPCOS in January 2021. A draft DPR prepared by M/s.WAPCOS has been submitted Bhavani and is under scrutiny of PWD. This work will be completed in March 2022.
Thamirabarani At present there is no proposal on biodiversity parks on the encroached River stretches and investigation works are being taken to implement it.
XII. Reuse of Treated Water - CMA The policy for promotion of use of Treated Waste Water is prepared with a vision to maximize the collection & treatment of sewage generated and reuse of treated waste water on a sustainable basis, thereby reducing dependency on fresh water resources. Further, the policy promotes use of treated waste water as an economic resource.
In this regard, Tamil Nadu Government has launched waste water reuse policy during December 2019. At present Memorandum of Understanding (MoU) has been executed between the ULB and the user agency for the re-use of secondary treated effluent water.

XII. Status of Preparation of Action Plan by the 14 Coastal States:

As per G.O.MS No.64 Environment and Forests (EC.2) Department dated 03.10.2020, preparation of action plan for the coastal and marine pollution by the Department of Environment, Government of Tamil Nadu, is under progress by collecting details from the 14 districts of Tamil Nadu.

XIII. Regulation of Mining Activities in the State/UT: -- XIV. Action against identified polluters, law violators and officers responsible for failure for vigorous monitoring: 2 CETPs have been closed.---

4. As regards the Salem Corporation is concerned, they have mentioned that there are four STPs functioning in Vellakuttai, Anaimedu, Mankuttai and Vandipettai. Though, they are having larger capacity, they are only treating with lesser capacity. They have also mentioned that some progress in the work done in several areas.

5. We have also received a status report submitted by the Commissioner, Salem City Municipal Corporation dated 23.07.2021, e-filed on 24.07.2021 and received on 26.07.2021 which reads as follows:

STATUS REPORT FILED BY THE COMMISSIONER OF SALEM CITY MUNICIPAL CORPORATION I, T.Christuraj, S/o. Thomas Frank, Indian, aged about 45 years, having office at Salem City Municipal Corporation, Salem
-- 636 001 do hereby solemnly affirm and state as follows:
1. I am the Commissioner, Salem City Municipal Corporation herein and I am the 6'" Respondent herein in the above Original Application and I am well acquainted with the facts of the case as per available record.
2. I respectfully submit that this Original Application was filed by the Applicant in the following prayer:
i) to direct the Second, Fourth and Fifth respondents to stop the inflow of contaminated water from the main channel of Thirumanimutharu river that are fed into the two tanks of Kollapatti and Mallasamudram Village of Thiruchengode Taluk, Namakkal District, by closing the feeder channel one and for all.
ii) To pump fresh water from Mettur dam by replacing the stagnated toxic water from the tanks of Kollapatti and Mallasamudram.
iii) To conduct environmental study by the first and second respondents and stop discharging polluted waste water into the river Thirumanimutharu in its flow of water through its channel from Yercaud Servarayan Hills to its end of Paramathi Velur -- Cauvery Basin.

3. It is respectfully submitted that this Hon'ble Tribunal was passed an order dated 08.06.2021 in Original Application No.51 of 2015 (SZ) among other things inter alia as follows: -

"16. So under such circumstances, we direct the Tamil Nadu Pollution Control Board, Central Pollution Control Board, Salem City Municipal Corporation to file further status report regarding the progress of the work and how much time it will take for completion of the underground sewage system and operation of STP so as to ensure that no untreated sewage water generated in Salem City Municipal Corporation is discharged into the Thimmanimutharu River which is the major source of pollution to the river water."

As per this Hon'ble Tribunal Order, I am filling this implementation progress details and project improvement report.

4. I respectfully submit the status of Underground Sewerage Scheme as on 19.07.2021 detailly herein below mentioned. Out of 7 packages 3 packages are collection system viz. package I, II & III. Out of the above package I & III were completed as stated in the earlier submission. The left out of portion of UGSS work in these two packages have been taken up and tender called on 14.10.2020 as stated in the previous status report filed by this respondent. In this regard, It is humbly submitted to state that the above work has been allotted to the successful tenderer M/s. VNV Builders Ltd, Gobichettipalayam, Erode. The progress of works got affected due to COVID-19 lockdown and at present the work is in progress and stated as follows. Out of 10.47 km length of sewerline so far 2.51 km have been laid likewise 93 no. of manholes have been constructed out of 390 manholes and 1.40 km length of house service connection pipes were laid out of the total length of 18.88 km. The remaining works pertaining to this contract is scheduled and will be completed before January-2022.

6. I respectfully submit that as stated in the previous status reports the first contract for this package-II collection system was terminated for non-achievement of mile stones. The terminated contract company had completed only 48% of the works in that project. For the left-out portion of the work retender was called on 28.11.2019 and the work was allotted to the successful tenderer, M/s.VW.construction (P) Ltd, Chennai on 18.02.2020at the cost of Rs.85.39 crores. The progress of work got affected due to COVID-19 lockdown and at present, this project is in progress and the stage is stated as follows.

Out of 77.07 km length of sewer line 10.16 km were laid. Out of 502 nos. of manholes, 425 nos. of manholes are completed. Regarding house service connection pipes 11.40kmof house service connections were laid out of 87.07 km. At present works are being carried out and the progress is being monitored and will be completed as per the stipulated time before August-2022.

a) It is submitted that, in Zone-I, Suramangalam, sewage is collected through the sewer lines already laid and the quantity of sewage entering the Manjuttai STP is 5 MLD. The Parameters such as BOD & COD, the norms of Tamil Nadu Pollution Control Board are being adhered and the treated effluent quantity of5 MLD and let into Thirumanimutharu River.

b) In Zone-2, Hasthampatty area, quantity of sewage entering the STP at Anaimedu is 4.60 MLD, and the parameters such as BOD & COD is maintained as per standard norms of Tamil Nadu Pollution Control Board and the treated effluent is let into River Thirumanimutharu

c) In Zone-3, Ammapet area, quantity of sewage entering into the Vellakuttai STP is 8 MLD, and the parameters such as BOD & COD is maintained as per standard norms of Tamil Nadu Pollution Control Board and the treated effluent is let into the River Thirumanimutharu.

d) In Zone-4, Kondalampatty comprising partly Ammapet and Hasthampati areas, will be connected to one STP at Vandipettai under trial run. At present sewage collected through the sewer line laid near Vandipettai STP area is now treated and the levels of BOD& COD are maintained as per TamilNadu Pollution Control Board norms. This STP will start functioning by Dec- 2021.

7. I respectfully submit that at present, out of 4 STPs, 3 STPs are functioning treating 17.60MLD of sewage and 4'h STP at Vandipettai trial run is progress and 1.0MLD of sewage is now treated in this STP. The collection system works nearby this STP are carried out under Package II of this project will increase the volumetric load to the STP up to5 0 MLD within December- 2021. Quantum of sewage load will be increased gradually by connecting the sewer lines of nearby residential and commercial clusters on speedy execution of collection system works. The progress of works will be informed to the Tamil Nadu Pollution Control Board. The total collection system will be completed by May-2023.

8. I submit that as on date, 4 Nos of STPs, with a total capacity of 98 MLD, a quantity of 17.60 MLD is now treated. In this system, out of 84,222 nos of HSCs12,530 Nos. of HSC had been provided so far and from which 17.60 MLD is being treated in three STPs. ByMay-2023it is plant to provide all the remaining HSCs. The samples of treated effluent are checked daily in the laboratory established in the STP at Vellakuttai, Mankuttai and Anaimedu. Parameters like COD & BOD are adhered with the norms of Tamil Nadu Pollution Control Board.

9. In further it is proposed to increase House service connections thereby the quantity of treated sewage will be increased and on this, only treated sewage will be let in the Thirumanimutharu River and no raw sewage left untreated will be reduced.

10. It is submitted that all the 3 STPs is operated efficiently as instructed by the TNPCB. The remaining 1 No. of STP namely Vandipettai will function full-fledged by December- 2021 and the left out works of conveyance system will be completed by Oct-2022 and all the 4 STPs will be operated in full-fledged manner there afterDecember-2021as advised by the TNPCB norms and will be adhered.

11. It is submitted that, in general the progress of UGSS works is expedited and will be completed. All STP's will function in its full capacity on completion of UGSS. Periodical testing of the treated effluent from STP is carried out by the operators and their report is submitted before this Hon'ble Tribunal. Consequently, TNPCB Salem has been requested to take samples of treated effluent and the results are awaited. The remarks raised by TNPCB will be carried out by the STP operators and followed by Salem Corporation As per this Hon'ble Tribunal Order the Salem Corporation expedite the work of underground sewage system and connecting the same to the STPs.

12. Under 15th State Finance commission, a project has been taken up to intercept the drains letting raw run off entering into River Thirumanimutharu and to divert them to the nearby sewer lines which in turn inflow leads to STP for treatment.

13. As submitted earlier, the alternative temporary solution which is being implemented to ensure the protection of Thirumanimutharu River form pollution is also catering the needs and thus the corporation has ensured that the sewage is not drained into the Thirumanimutharu River, It is seen the above the alternative action as well as permanent action were taken by the Salem Corporation in order to prevent the pollution.

Under the above circumstances, it is humbly prayed that this Hon'ble Tribunal this Status Report may be taken on file and such suitable orders may be passed and thereby render justice.

6. It is seen from the status report that though there is certain progress in implementing the underground sewage system in Salem Municipal Corporation area and also in connecting the sewerage line from independent residents with the underground sewage system, they have not achieved the 100 per cent implementation. They have given about the present stage as follows:

7. Similarly giving connection to the existing houses, there is also a huge gap which the Corporation has to take immediate steps to quicken the process of work and complete the same at minimum possible time. As regards the sewage treatment plants are concerned, they have mentioned as follows:

Here also it was mentioned that as regards the Vellakuttai and Mankuttai are concerned, they have obtained consent to operate as well and as regards Anaimedu and Vandipettai are concerned it is only at the stage of consent to establish but it is seen from this report that as far as Anaimedu is concerned it was mentioned that it was commenced and under operation. It will be seen from the report that though, installed capacity of Vellakuttai, Anaimedu and Mankuttai STPs are concerned they are having a total capacity of 54MLD, whereas they are using for treatment only upto the capacity of 17MLD. There is a gap of 37 MLD which is being not utilised by the Corporation. Till the underground sewage system and connection of sewer lines are completed, they can collect the sewage from those areas not covered by underground sewage system in tanker lorries and the same can be treated in these three STPs so that STPs can be used at optimal level and thereby discharge of untreated sewage into the river to that extent can be reduced. Further they are also directed to complete the work of Vandipettai and make it fully operational immediately so that about 44MLD of sewage can be treated using that facility so that much quantity of untreated sewage can be prevented being discharged into the river. But as regards the Anaimedu STP is concerned, they will have to obtain consent to operate as well before it is put to optimal use.

10. District Collector, Salem is directed to convene a meeting of the Commissioner, Salem Municipal Corporation and the neighbouring Town Panchayats so as to ascertain as to whether, if the nearby Town Panchayats are not having STP facilities, the sewage that is being generated from that area can be diverted to nearby STPs that are operated by Salem Corporation, if they have spare capacity after meeting the treatment of sewage generated within Salem Corporation. Only if excess capacity is available, that portion can be utilised for the purpose of catering to the needs of neighbouring Town Panchayats to the extent of the gap available.

11. The Pollution Control Board is also directed to file an independent report regarding the progress of the work and improvement in the water quality of the disputed river after the achievement of some improvement by the Salem Corporation in implementing the underground sewage system.

12. The Salem Corporation is also directed to take steps to quicken the process of completion of underground sewage system by giving directions to the contractors to whom that works have been entrusted, as it is seen from the report that one of the contractor will be able to finish the work only in August, 2022 and the underground sewage connections of the un- connected residences could be possible only by May, 2023.

13. The discharge of untreated sewage into the river till that date cannot be permitted. They will have to find out alternative methods for treating sewage either by the method suggested by us in para 9 and 10 or some other method to avoid un-treated sewage being discharged into the Thirumanimutharu River and to save the river from pollution.

14. The Joint Committee is also directed to inspect the area again and submit the progress report and also improvement in the water quality and suggest further remedial measures including short-term measures to achieve the water quality in Thirumanimutharu River by avoiding discharge of untreated sewage till underground sewage system is completed and fully utilised by the Corporation.

15. The Tamil Nadu Pollution Control Board is also directed to file detailed report regarding the action taken by them for non-

compliance of the directions given by the Principal Bench in O.A. No. 606 of 2018 by the Salem Corporation in implementation of the establishment of STPs and other provisions of Solid Waste Management Rules, 2016 in their area of jurisdiction.

16. The District Collector is also directed to file independent report regarding the action taken by him as directed by this Tribunal and progress of its implementation before the next hearing date.

17. They are directed to submit the respective reports to this Tribunal on or before 18.11.2021 by e-filing in the form of Searchable PDF/OCR Supportable PDF and not in the form of Image PDF along with necessary hardcopies to be produced as per Rules.

18. The Registry is directed to communicate this order to the members of the Committee, Tamil Nadu Pollution Control Board, Commissioner, Salem Corporation and also to District Collector, Salem, Additional Chief Secretary, Municipal Administration and Water Supply and Director, Municipal Adminstration for their information and also to supervise and quicken the process of completion of underground sewage system in Salem Corporation and any logistic and financial support, if any is required by Salem Corporation, they must take immediate steps for providing the same as well for this purpose.
