Section 4(2)(b) in The Bihar Self-Supporting Co-operative Societies Tribunal (Constitution and Procedure) Rules, 2002

(b)Where an appeal or application is heard by a Bench constituted of two members whether it consists of the Chairman or not and the members are divided in opinion on any point or points, such point shall be referred to a Bench consisting of all the three members including Chairman.
