12/08.03.2018 Heard learned counsel for the appellants as well as respondents.

The present appeal has been filed against the order dated 29.05.2013 passed by the learned Sub-ordinate Judge-I, Ranchi in Partition Suit No. 341 of 2012 whereby the petition filed by the appellant under Order XL Rule-I read with Section 151 of the Code of Civil Procedure has been rejected.

Being a Partition Suit, it is fight amongst the family members. The matter has been argued on different dates in detail and efforts have been made by this Court for compromise.

Parties has agreed to the dispute and accordingly defendant nos. 2 and 4 have also agreed to furnish the detail before Court below regarding income expenses and deposit towards the loan accounts, so far as the property involved in Partition Suit is concerned.

Learned counsel for the appellants also agrees on such consent given by the defendant nos. 2 and 4.

In view of the above agreement between the parties, the present appeal is disposed of with a direction to the Court below to conclude the Partition Suit as soon as possible and further to direct the defendant nos. 2 and 4 to furnish the details of income, expenses and deposit towards the loan accounts as agreed before this Court.

With the aforesaid observation and direction, this appeal stands disposed of.
