By way of this application, the applicant is seeking bail in connection with Crime No.311/2025 registered with the Aroli Police Station, District Nagpur for the offence punishable under Sections 309(4),309(6) 118(1), 324(2), 3(5), 61(2)(a) of the Bharatiya Nyaya Sanhita, 2023, on the ground of parity.

The informant lodged the First Information Report alleging that on 10.10.2025 when the informant along with his driver left from Dharmapuri to Bhandara by truck after supplying the groceries and collecting an amount of Rs.2,40,000/-, on the way, his truck broke down. At that time, three unknown persons including the present applicant came there on white moped, forcefully snatched the bag containing Rs.2,40,000/- and on resistance they allegedly assaulted the informant and the driver.
4. Learned Counsel for the applicant submits that though prima facie there is material against the applicant, however there are no criminal antecedents 2 42.ba.367.2026 against the applicant. The applicant is behind bars since 13.10.2025. Also the other co-accused has been released on bail by the learned Additional Sessions Judge-19, Nagpur, who was standing on the same footing as that of the applicant, which was decided at a later point of time i.e. on 01.04.2026 whereas the application of the applicant was rejected on 30.01.2026. Therefore, it is submitted that on the ground of parity, the applicant deserves to be enlarged on bail.

On the other hand learned APP vehemently opposes the application on the ground that at the behest of the applicant the amount of Rs.1,31,240/- was recovered and that at the time of incident, the applicant was in constant touch with other co-accused, which could be gathered from CDR report. The applicant was also identified in the Test Identification parade. It was prayed that as there is ample material against the applicant, the application deserves to be rejected.
6. I have considered the rival submissions and perused the record. It appears that the Trial court has granted bail to another co-accused namely Dev @ Deva s/o Ratratan Chandrikapure on the ground that as he is in jail since 13.10.2025, the investigation is complete and charge-sheet is also filed and therefore, no further custodial interrogation is required and that there are no criminal antecedents. The applicant is also praying for bail on the ground of parity. Considering the fact that the present applicant is also standing on the same footing, I am inclined to enlarge the applicant on bail. Hence the following order :
(a) The application is allowed.

(b) The applicant Bhagwat @ Bhagu s/o Amrut Varma in connection with Crime No.311/2025 registered with the Aroli Police Station, District Nagpur be released on bail on furnishing P.R. bond of Rs.50,000/- with one surety in the like amount.
(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
(d) The applicant shall provide his residential address and cell number to Police Station concerned and shall not change his place of residence without prior intimation to the Investigating Agency.
(e) The applicant shall not commit any similar type of offence.
(f) The applicant shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates, or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.
7. All Misc. application(s), pending if any, shall stands disposed of accordingly.
