                                              ORDER

FACTS The Appellant vide his RTI application sought information as under:-

"a. First time Labour Card Application on eDistrict portal starts with 5138000 and ends with consecutively serialled 7 digits. For example, Application 51380001476533. As on date of reply of RTI, please tell total number of such Applications filed on eDistrict portal. b. Out of the above, please give break up as (i) approved, (ii) rejected, (iii) under consideration. c. Renewal of Labour Card Application on eDistrict portal starts with 50480000 and ends with consecutively serialled 6 digits. For example, Application 50480000238850. As on date of reply of RTI, please tell total number of such Applications filed on eDistrict portal. d. Out of the above, please give break up as (i) approved, (ii) rejected, (iii) under consideration. e. As on date of reply of RTI, please tell total number of Active Labour Cards. That is Labour Cards which are not due for renewal."

Dissatisfied due to non - receipt of any response from the CPIO, the Appellant approached the FAA. The order of the FAA, if any, is not on the record of the Commission. Thereafter, the Appellant filed a Second Appeal before the Commission.

HEARING:

Facts emerging during the hearing:

The following were present:

Appellant: Mr. Aakash Goel, attended the hearing. Respondent: Mr. Rajeev Kumar, Deputy Secretary, CMO & CPIO and Dr. Anshul Mudgal, SMO, attended the hearing.

The Appellant while reiterating the contents of the instant RTI Application stated that the Respondent has not provided the relevant information as sought in the instant RTI Application.

The Respondent while defending their case submitted migration of record/data took some time as their office has shifted to new portal from e-district in March 2023 and now they will provide the relevant information to the Appellant.

DECISION:

The Commission after adverting to the facts and circumstances of the case, submission made by both the Respondent, the Commission directs the CPIO to provide a concise reply to the Appellant with respect to the instant RTI application, in accordance with the spirit of transparency and accountability as enshrined in the RTI Act, 2005 within a period of 30 days from the date of receipt of this order under the intimation to the Commission. For the redressal of his grievance, if any, the Appellant may approach an appropriate forum. The Appeal stands disposed of accordingly.
