Learned counsel for the petitioner, by the instant petition, is challenging the advertisement dated 19.03.2021 (Annexure P/4) issued by the respondent No. 3 mainly on the ground of competence.

Learned counsel for the petitioner submits that there are several other petitions, which are pending and linked alongwith WP Nos. 11194/2018 and 8015/2021.

Learned counsel for the respondents, on the other hand, has opposed the submission made by the learned counsel for the petitioner and apprised this Court that the issued raised by the petitioner has already been decided by the Gwalior Bench by order dated 03.08.2021 passed i n WP No. 11465/2021-Rama Mahila Bachat Evam Sakh Swa Sahayata Samooh vs. State of M.P & others dismissing the petition after imposing the cost upon the petitioner therein, as he had suppressed the material fact that the Clause 12.1 of the guidelines dated 20.01.2021, on which he had relied upon, had already been removed by the amended guidelines dated 05.05.2021. According to the learned counsel for the respondents, in this petition also the petitioner has suppressed the material fact that the new guidelines have already been introduced on 05.05.2021. Therefore, this petition also deserves to be dismissed with cost in identical manner as has been decided by the Gwalior Bench in WP No. 11465/2021.
