Background
1. The Appellant filed his RTI application dt.1.4.08 with the CPIO, ICCR.
He sought information against 23 points. Not satisfied with the information provided by the CPIO, he preferred an appeal dt. 16.6.08 before the Appellate Authority stating that information provided by the CPIO is incomplete and misleading. The First Appellate Authority replied on 30.7.08 upholding the decision of the CPIO. The Appellant preferred his second appeal before the CIC on 18.9.08
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing on January 12, 2009.
3. Mr. Ajit Gupte, Dy. Director General, ICCR and Mr. P. Roychaudhuri, Advocate represented the Public Authority.
4. The Appellant was present at the hearing.
Decision
5. The Commission noted that the information sought by the Appellant is voluminous and that some of the questions did not seek 'information' as defined in the RTI Act. The Commission, therefore, directs the Appellant to prioritize issues, cut down on the number of questions and seek relevant information against not more than 5 to 6 points. The Appellant to provide the final list of questions against which he is seeking information (along with his comments on the information that has already been provided by the PIO) within 5 days of receipt of this Order (preferably by e-mail ) to the Respondents and the Respondents, in turn, to provide the information (based on the Appellant's comments) within 15 days of receipt of the prioritized list of questions from the Appellant. Where information is not available, the Respondent to clearly state that information in the format sought by the Appellant is not available with ICCR.
6. The appeal is disposed off.
