ORAL ORDER
11 11-05-2022Learned counsel for Union of India seeks further time to comply the order dated 30th March, 2022.
The concerned officials of Union of India is hereby directed to take note of subsequent event including various counter affidavit and Interlocutory Applications and affidavits filed on behalf of petitioners. Such counter affidavit be filed before the next date of hearing, failing which it is understood that there is no statement of objection/ counter affidavit on behalf of Union of India.
Some of the counsels for the petitioners submitted that the State- officials respondents, in particularly, District Programme Officers is denying salary to such of those persons irrespective of trained teachers and untrained teachers who are all working. In this regard, each of the District Programme Officer is hereby directed to pay arrears of salary to each of the petitioner who have not been paid during the pendency of the present petition and further to continue to pay till further order with condition that such payment of salary is Patna High Court CWJC No.16214 of 2019(11) dt.11-05-2022 113/113 subject to result of present petition. Hon'ble Supreme Court held that even if appointment was irregular, State has to pay salary for work done by employee in the case of Man Singh Vs. State of U.P. vide 2022 live law SC 341.
If salary is not paid to such of those petitioners, in that event, District Programme officers are directed to file individual affidavit and he/she must present in the Court on the next date of hearing along with relevant records.
Re-list this matter on 23.06.2022.
