02 / 28.01.2026      Learned counsel for the Respondents states that in terms of the office

order dated 16th December, 2025, an appeal can be filed before the Tribunal. However, he admits that the Tribunal is not fully functional and that it is likely to be functional in the next one or two weeks, according to the instructions imparted to him.

2. Accordingly, learned counsel for the Respondents submits that hearing in this petition may be deferred for one or two weeks, so that he is in a position to make a clearer statement on the next occasion.

3. We post this petition on 17th of February, 2026. This is because the order impugned in this petition is an appealable order. If the appellate remedy is available, then, we will consider whether the petitioner should be relegated to avail such remedy, rather than entertaining this petition.
