Information soughtand background of the case:
Vide RTI application dated 09.05.2016, the appellant sought information regarding Drug & Cosmetic Rule whereby all clinical trials permitted on or after 15th June 2009 are mandatorily registered in CTRI, ICMR under permission from DCGI and sought certified copies of documents along with list of prescribed formalities regarding specific drug trial as per rule. The CPIO furnished the reply vide letter dated 31.08.2016 & 02.06.2016. Dissatisfied with response received from CPIO, the appellant filed first appeal. The FAA vide letter dated 13.12.2016 stated that:
"..........as per available records Somatostatin Injection and Somatostatin IV infusion were approved by this office in 30.06.1994 and 24.04.1995, respectively. Therefore no information is available with this office regarding any clinical trial conducted at Medanta Medicity in 2011.
Further, this office had also not granted any clinical trial permission related to Somatostatin under Global Clinical Trial permission from 2011 to till date."
Feeling aggrieved, the appellant approached the Commission.

The respondent states that information as available on record has already been furnished to the appellant. The FAA also informed the appellant that as per available records Somtostatin Injection and Somatostatin IV infusion were approved by this office in 30.06.1994 and 24.04.1995 and no information is available regarding any clinical trial conducted at Medanta Medicity in 2011. He further stated that this office had also not granted any permission for clinical trial regarding Somatostatin under Global Clinical Trial permission from 2011 to till date.
Decision:
After hearing parties and perusal of record, the Commission finds that information as available on record has already been furnished to the appellant.
The appeal is disposed of accordingly.
