ORAL JUDGMENT

Date: 21-09-2017 Heard learned counsel for the parties.

The petitioner is aggrieved by the time frame given in the auction notice at Annexure-1 which gives the intending applicants a period of 7 days to prepare themselves for the auction.

Mr. Jitendra Kumar Roy learned counsel appearing for the petitioner relies upon an advisory issued by the Mining Department dated 3.10.1982 to submit that a minimum of 15 days time has been granted for any such settlement.

Mr. Rajendra Prasad learned counsel appearing for the Mining Department by contesting the submissions submits that the issue is different in the present case which is an auction of unclaimed sand Patna High Court CWJC No.14021 of 2017 dt.21-09-2017 2/2 that has been seized by the Department while advisory relied upon relates to settlement of Sand Ghats.

The submission of Mr. Rajendra Prasad appearing for the department clarifies the position and even otherwise 7 days time to any intending applicant is sufficient enough for getting prepared for the auction.

In the circumstances, no cause for indulgence is made out. The writ petition is disposed of.
