An Act to provide for the principles in respect of determination of compensation for land needed for a public purpose in areas suitable for industrial development.It is hereby enacted in the Twelfth Year of the Republic of India as follows:Section 1. Short title and extent(1)This Act may be called the Gujarat Land Acquisition (Industrial Areas) Act, 1961. (2)It extends to be whole of the State of Gujarat.Section 2. DefinitionIn this Act unless the context otherwise requires (1)notified area means any area notified under section 3; (2)specified data in relation to a notified area means the 1st day of January 1961.Section 3. Power of State Government to notify areasFor the purpose of facilitating the development of industries in the State of Gujarat the State Government may, by notification published in the Official Gazette, notify any area in which land in its opinion is suitable or likely to be required for any of the following purpose, that is to say,(a)the establishment of any industrial or manufacturing unit by the State Government; (b)development of land by or for the State Government for the purpose of facilitation the location of industries thereon. Section 4. Amendments subject to which Land Acquisition Act shall apply to acquisition of land for industrial development (1)Where in a notified area any land is acquired under the land Acquisition Act, 1894 (I of 1894) (hereinafter referred to as the said Act ) or under the Land Acquisition Act, 1894 as applied to the Saurashtra area of the State of Gujarat (Sau. Ord. XXI of 1948) (hereinafter referred to as the Saurashtra Act ) for any of the purpose specified in the clause (a) and (b) of section 3 then in relation to such acquisition.(a)the said Act shall have effect as if(i)in section 11, after the words, figures and brackets section 4, sub-section (1) the words, brackets and figures and at the specified date as defined in the Gujarat Land Acquisition (Industrial Areas) Act, 1961 (Guj. XLVI of 1961) (hereinafter referred to as the said specified date ) had been inserted; and (ii)in section 23 in the first clause of sub-section (1), after the words, figures and brackets section 4, sub-section (1) the word or at the said specified date, whichever is less had been inserted. (b)the Saurastra Act shall have effect as if(i)in section 11, after the words, figures and brackets section 4, sub-section (1) the words, brackets and figures and at the specified date as defined in the Gujarat Land Acquisition (Industrial Areas) Act, 1961 (Guj. XLVI of 1961) (hereinafter referred to as the said specified date ) had been inserted; and (ii)in section 23 in the first clause of sub-section (1), after the words, figures and brackets section 4, sub-section (1) the word or at the said specified date, whichever is less had been inserted. (2)Nothing in this section shall apply to any building.Section 5. Removal of doubtFor the removal of doubt it is hereby expressly declared that nothing in this Act shall affect the provisions of the Land Acquisition (Bombay Amendment) Act, 1948 (Bom. IV of 1948), and the Land Acquisition (Bombay Amendment) Act, 1960 (Bom. XVII of 1960).
