COMMON JUDGMENT
(Judgment of the Court was made by R.SUBRAMANIAN, J.) The core issue involved in these appeals is with reference to the career advancement scheme introduced by the Government of Tamil Nadu for teaching faculty in Polytechnic and Engineering Colleges, which come under the Higher Education Department of the Government of Tamil Nadu. The two Government Orders namely, G.O.Ms.No.111, Higher Education Department dated 25.05.2010 and G.O.Ms.No.95 dated 05.05.2010 are the relevant Government Orders which promulgate the career advancement scheme for the teaching faculty as well as the Physical Education Directors working in the said Institutions.
2. Though many of the petitioners before the writ Court were granted the benefits under the said Government Orders, they were subsequently withdrawn under various proceedings, which were subject matter of challenge in the writ petitions. The learned single Judge had bunched those writ petitions and by a common order dated 06.03.2024 made in several writ petitions had issued the following directions:-
“42. So on the background of the above discussions, the following conclusions are arrived:-
https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 i.G.O.(Ms).No.111, dated 25.05.2010 is applicable in respect of CAS, only for those persons who had attained the eligibility criteria on and from 25.05.2010 and not any time before and no retrospective effect be given to the above said Government Order.
ii.Even though the AICTE Regulations, 2012 states about an earlier date i.e. 05.03.2010, its applicability can be taken into effect only from the date of the Government Order and not from 05.03.2010.
iii.Even if the Training and Publication norms as prescribed under G.O.(Ms).No.111, dated 25.05.2010 are not complied for those who attained the eligibility on and from 25.05.2010, they will also be eligible to get CAS, if they are otherwise qualified as per G.O.(Ms).No.111, dated 25.05.2010. This has been clarified in the subsequent G.O.(Ms).No.58, dated 21.03.2018.
iv.For those persons, who have attained eligibility criteria before 25.05.2010 for getting CAS will only be governed under Regulations, 2010 r/w G.O.(Ms.)No.1081, dated 19.08.1989 and not G.O.(Ms).No.111, dated 25.05.2010.” with reference to the implementation of the career advancement scheme to Teachers in Polytechnics which governed by G.O.Ms.No.111 dated 25.05.2010.
3. With reference to Teachers in Engineering Colleges, the learned single Judge had issued the following directions with reference to G.O.Ms.No.95 which governs the career advancement scheme for Teachers in Engineering Colleges:-
“10. In view of the above discussions and observations made in the above case which is applicable to this case, the writ petitions https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 are disposed by quashing the impugned orders and by giving the following conclusions:
i) G.O.(Ms).No.95, dated 05.05.2010 is applicable in respect of CAS, only for those persons who have attained the eligibility criteria on and from 05.05.2010 and not any time before and no retrospective effect be given to the above said Government Order.
ii) Even though the AICTE Regulations, 2012 states about an earlier date i.e. 05.03.2010, its applicability can be taken into effect only from the date of the Government Order and not from 05.03.2010.
iii) Even if the Training and Publication norms as prescribed under G.O.(Ms).No.95, dated 05.05.2010 are not complied for those who attained the eligibility on and from 05.05.2010, they will also be eligible to get CAS, if they are otherwise qualified as per G.O.(Ms).No.95, dated 05.05.2010. This has been clarified in the subsequent G.O.(Ms).No.62, dated 21.03.2018.
iv) For those persons, who have attained eligibility criteria before 05.05.2010 for getting CAS will only be governed under Regulations r/w G.O.(Ms.)No.305, dated 18.07.2000 and not G.O. (Ms).No.959, dated 05.05.2010.”
4. As regards Physical Directors, they were dealt with under both the Government Orders namely, G.O.Ms.No.95 dated 05.05.2010 and G.O.Ms.No:111 dated 25.05.2010 and the provisions almost similar. In respect of Physical Education Directors also, the same directions were issued by the learned single Judge. The State is on appeal against these orders passed. As the core issue relates to implementation of the career advancement scheme https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 introduced by the Government of Tamil Nadu, all these cases are taken up together and disposed of by this common judgment.
5. The brief history of the career advancement scheme is as follows:-
Originally, in the year 1989, the Government passed two Government Orders namely, G.O.Ms.No.1080, Education (J1) Department dated 19.08.1989 and G.O.Ms.No.1081 dated 19.08.1989. Those two Government Orders are similarly worded. G.O.Ms.No.1080 confers certain benefits on teaching faculty and other staff of Engineering Colleges and G.O.Ms.No.1081 also dated 19.08.1989 confers certain benefits on Teachers in Polytechnics and special diploma technical institutions. The scheme was termed as upgrading scheme in G.O.Ms.No.1081 whereas, the same was termed as career advancement scheme in G.O.Ms.No.1080.
6. Clause-VII of G.O.Ms.No.1080 reads as follows:-
“7. Career Advancement: Every Lecturer will be placed in a senior scale of Rs.3,000 - 5,000 if be has.-
(c) completed 8 years of service after regular appointment with relaxation in service provided in paragraph 6 above;
(b) participated in two Refresher course of Summer institutions each approximately four weeks duration or in other comparable Continuing Education Programmes approved by the AICTE
(c) consistently satisfactory performance appraisal reports.
https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 All Lecturers in the existing scale of Rs. 700-1,600 who have completed 8 years of service on 1st January 1986 will be placed through a process of screening/selection in the scale of Rs. 3,000- 5,000. The benefit of service provided in paragraph 6 above will be available for the initial placement also. The flexible complimentary scheme shall be discontinued with immediate effect.
Every Lecturer in the senior scale will be placed in a Selection Grade of Rs. 3,700-5,700 on completion of 8 years in the senior scale with relaxation in service as provided in paragraph 6 above. Placement in the Selection Grade will be through a process of selection by a Selection Committee set up by the appointing authorities. Only those who have attended two Refresher courses or Summer institute or any comparable continuing education programmes approved by the AICTE after placement in the Senior scale and whose performance has been assessed as consistently good will be eligible for placement in the Selection Grade.
Lecturers in the existing Selection Grade of Rs. 1,200-1,900 in Engineering Colleges and other institutions will be placed at the appropriate stage in the revised Selection Grade of Rs. 3,700- 5,700 in accordance with the fixation formula under this Scheme. The existing Lecturers who have completed or will complete a total period of 16 years of service on 1st January 1986 or thereafter will be eligible for placement in the Selection Grade. They will also be entitled to the relaxation in the years of service as provided in paragraph 6 above.

7. The upgrading scheme introduced for staff, both the teaching and non-
teaching in G.O.Ms.No.1081, Education (J-1) Department dated 19.08.1989 is found at Clause – 10 and it reads as follows:-
“10. Upgrading Scheme:
The Upgrading Scheme in Polytechnics will be modified in future on the basis of the number of years of service put in by them and qualification. An Associate Lecturer with 10 years experience and possessing the qualification required for a Lecturer may be upgraded as Lecturer on completion of 10 years of satisfactory service as Associated Lecturer. Similarly the Lecturer with 10 years of satisfactory service as Lecturer and having the qualification required for a Head of Department will be upgraded as a head of Department. They will also be eligible for service concessions detailed in paragraphs 8 and 9 above. However, persons who have already moved to Higher Categories by existing upgradation scheme will be allowed to continue in that post provided the possesses the prescribed qualification.”

While G.O.Ms.No.1081 which applies to Polytechnics and special Diploma Institutions, restricts the eligibility criteria only based on the number of years of service for being upgraded as a Lecturer from the post of Associate Lecturer and Head of the Department from the post of Lecturer, the career advancement scheme for Teachers in Engineering Colleges as enumerated in Clause-7 of G.O.Ms.No.1080 dated 19.08.1989 provides for certain other https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 qualifications like attending refresher courses and comparable continuing education programmes approved by the All India Council for Technical Education (AICTE) to be placed in the selection grade. Subsequently, the Government came up with G.O.Ms.No.305 dated 18.07.2000 in respect of Engineering Colleges and the said Government order provided for constitution of a committee to consider upward movement of Teachers under the career advancement scheme under G.O.Ms.No.1080 for Engineering Colleges.
Similarly, the Government came up with G.O.Ms.No.563 dated 31.12.2004 and G.O.Ms.No.337 dated 27.08.2009 in respect of Teachers in Polytechnic Colleges.
9. Upon the notification of the 6th Pay Commission recommendations, the Government came up with two Government Orders referred to supra namely, G.O.Ms.No.95 in respect of Engineering Colleges and G.O.Ms.No.111 dated 25.05.2010 in respect of Polytechnics and other special Diploma Institutions. It is not in dispute that the Teachers who had qualified under G.O.Ms.No.1080 and 1081 issued in the year 1989 had been conferred the benefits under the said two Government Orders. The only issue that was agitated before the writ Court was the eligibility criteria under the two Government Orders issued during May, 2010 namely, G.O.Ms.No.95 dated 05.05.2010 and G.O.Ms.No.111 dated 25.05.2010. All these bunch of cases, which are now before us relate to Teaching staff in Polytechnics, Engineering Colleges and Physical Education https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 Directors in both the Institutions.
10. While G.O.Ms.No.95 deals with faculty in Engineering Colleges, G.O.Ms.No.111 deals with faculty in Polytechnics. Slightly different guidelines were prescribed for conferment of the benefits under the career advancement scheme on these Teachers. Let us first deal with G.O.Ms.No.111, Higher Education Department dated 25.05.2010 which governs the issue relating to Polytechnics and special Diploma Institutions. The said Government Order is a composite one, which seeks to implement the revised pay scales and also provide for career advancement scheme in Government and Government aided Polytechnics governed by the AICTE.
11. The first part of the Government Order, which is titled as General, prescribes the designations in Polytechnics. The second part provides for the pay structure and incentives that are to be granted for acquisition of higher qualifications. The third part provides the pay fixation formula which is based on the UGC scales. Schedule – II of the said Government Order specifies the existing scale of pay to various posts and Appendix-I sets out the career advancement scheme for Teachers and other equivalent positions. 12. Clause – I of Appendix-I to the said Government Order which relates to Lecturers in Polytechnics reads as follows:-
APPENDIX - I Revised Pay Scales, Service conditions and Career Advancement Scheme for teachers and equivalent positions:
The pay structure for different categories of teachers and equivalent positions shall be as indicated below:
1. Lecturer in Polytechnics
(i) Persons with B.Tech qualification in appropriate branch / discipline either entering the teaching profession newly or Lecturers already in service in Polytechnic Institutions shall be designated as Lecturer and shall be placed in the Pay Band of Rs.15600-39100 with AGP of Rs.5400 and will move to AGP of Rs.6000 on completion of Masters degree in qualification in appropriate branch / discipline.
(ii) Persons with M.Tech qualification in appropriate branch / discipline either entering the teaching profession newly or Lecturers already in service in Polytechnic Institutions shall be https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 designated as Lecturer and shall be placed in the Pay Band of Rs.15600-39100 with AGP of Rs.6000.
(iii) A Lecturer with completed service of 4 years, possessing Ph. D Degree in the relevant branch / discipline shall be eligible, for moving up to AGP of Rs.7000.
(iv) A lecturer possessing Masters degree in the relevant branch / discipline as defined for technical education shall be eligible for the AGP of Rs.7,000 after completion of 5 years service as Lecturer.
(v) Lecturers who do not have Ph.D or a Master's degree in the relevant branch / discipline of a program shall be eligible for the AGP of Rs.6,000 only after completion of 6 years' service as Lecturer.
(vi) Lecturers who do not have Ph.D or a Master's degree in the relevant branch / discipline of a program shall be eligible for the AGP of Rs.7,000 only after completion of 9 years' service as Lecturer.
(vii) The upward movement from AGP of Rs.5000 to AGP of Rs.6000 and from AGP of Rs.6000 to Rs.7000 for all Lecturers shall be subject to their satisfying other conditions as laid down by All India Council for Technical Education / State Government.
(viii) The pay of the incumbents to the posts of Lecturer (senior scale) (i.e. the pre-revised scale of Rs.10,000-15200) shall be fixed at the appropriate stage in Pay Band of Rs.15600- 39100 based on their present pay, with AGP of Rs.7000.
(ix) Lecturers with completed service of 5 years with the AGP of Rs.7000 shall be eligible, subject to other requirements laid down by the All India Council for Technical Education / State Government to move up to the AGP of Rs.8000.

(x) Incumbent Lecturers (Selection Grade) who have completed 3 years in the pre-revised pay scale of Rs.12000-18300 on 1.1.2006 shall be placed in Pay Band of Rs.37400-67000 with AGP of Rs.9000 and shall be continued to be designated as Lecturers (Selection Grade)
(xi) Incumbent Lecturers (Selection Grade) who had not completed three years in the pay scale of Rs.12000-18300 on 1.1.2006 shall be placed at the appropriate stage in the Pay Band of Rs.15600-39100 with AGP of Rs.8000 till they complete 3 years of service in the grade of Lecturer (Selection Grade), and thereafter shall be placed in the higher Pay Band of Rs.37400- 67000 and accordingly designated as Lecturers (Selection Grade)
(xii) Lecturers (Selection Grade), completing 3 years of teaching with the AGP of Rs.8000 shall be eligible, subject to other conditions, as may be prescribed by All India Council for Technical Education / State Government to move to the Pay Band of Rs.37400-67000 with AGP of Rs.9000.
xiii) Posts of Head of Department shall be in the Pay Band of Rs.37400-67000, with AGP of Rs.9000. Directly recruited Head of Department shall be placed in the Pay Band of Rs.37400-67000 with an AGP of Rs.9000, at the appropriate stage in the Pay Band in terms of the conditions of appointment.
(xiv) Head of the Department (HOD), completing 3 years of service in the AGP of Rs.9000 and possessing a Ph.D. degree in the relevant discipline shall be eligible, subject to other conditions of academic performance as laid down by the All India Council for Technical Education / State Government, shall be placed in Rs.37400-67000 with AGP of Rs.10000.
(xv) For initial direct recruitment at the level of Lecturers, https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 Head of Department and Principal, the eligibility conditions in respect of academic and research requirements shall be as may be or have been prescribed by the All India Council for Technical Education / State Government through Regulations.
(xvi) All advancements to higher grade pays in various cadres will be effected subject to completion of two All India Council for Technical Education / State Government approved refresher programs of not less than two weeks duration each and two one week each Technical Education Quality Improvement Programme (TEQIP) sponsored programmes.”
13. In so far as the Physical Education Directors are concerned, Clause – 4 of Appendix-I of G.O.Ms.No.111 provides for both career advancement scheme and pay scales and it reads as follows:-
“4. Pay Scales and Career Advancement Scheme for Physical Education Personnel:
(a) Assistant Director of Physical Education (Assistant DPE)/ College Director of Physical Education (College DPE)
(i) The Assistant Director of Physical Education/ College Director of Physical Education in the pre-revised pay scale of Rs.8000- 13500 shall be placed in the Pay Band of Rs.15600- 39100 with AGP of Rs.6000.
(ii) Pay of incumbent Assistant Directors of Physical Education/ College Director of Physical Education shall be fixed at an appropriate stage in the Pay Band of Rs.15600-39100 with AGP of Rs.6000, in accordance with the 'fixation formula' of the 6th Central Pay Commission (CPC)

(i) Assistant Directors of Physical Education (Senior Scale)/ College Director of Physical Education (Senior Scale) in the pre-
revised pay scale of Rs.10000-15200 shall be placed in the Pay Band of Rs.15600-39100 with AGP of Rs.7000.
(ii) Assistant Directors of Physical Education (Senior Scale)/ College Director of Physical Education (Senior Scale) possessing Ph.D. in Physical Education at the entry level of Assistant Director of Physical Education / College Director of Physical Education in the AGP of Rs.6000 shall, after completing service of four years in the AGP of Rs.6000, and if otherwise eligible as per guidelines prescribed by the All India Council for Technical Education / State Government move to higher AGP of Rs.7000 in the Pay Band of Rs.15600-39100.
(iii) Assistant Directors of Physical Education (Senior Scale)/ College Director of Physical Education (Senior Scale) possessing M.Phil in Physical Education at the entry level of Assistant Director of Physical Education / College Director of Physical Education in the AGP of Rs.6000 shall, after completing service of five years in the AGP of Rs.6000, be eligible for the higher AGP of Rs.7000.

(v) Pay of incumbent Assistant Directors of Physical Education (Senior Scale)/ College DPE (Senior Scale) shall be fixed in Pay Band of Rs.15600-39100 at an appropriate stage in the AGP of Rs.7000, as per the 'fixation formula' of the 6th CPC.
(c) Deputy Director of Physical Education / Assistant Director of Physical Education (Selection Grade)/ College Director of Physical Education (Selection Grade)
(i) After completing service of five years in the Pay Band of Rs.15600-39100 with the AGP of Rs.7000 and subject to satisfying other eligibility conditions laid down by the All India Council for Technical Education / State Government, Assistant Director of Physical Education (Senior Scale)/ College Director of Physical Education (Senior Scale) shall move to AGP of Rs.8000 in the Pay Band of Rs.15600-39100. They shall be designated as Deputy Director of Physical Education/ Assistant Director of Physical Education (Selection Grade)/ College Director of Physical Education (Selection Grade), as the case may be.
(ii) After completing service of three years in the Pay Band of Rs.15600-39100 and the AGP of Rs.8000 and subject to eligibility laid down by the All India Council for Technical Education / State Government Deputy Director of Physical Education / Assistant Director of Physical Education (Selection Grade)/ College Director of Physical Education (Selection Grade) https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 shall move to the Pay Band of Rs.37400-67000 with the AGP of Rs.9000. (iii) All Incumbents to the post of Deputy Director of Physical Education / Assistant Director of Physical Education (Selection Grade)/College Director of Physical Education (Selection Grade) who have completed service of at least three years in the pre-revised Pay Scale of Rs.12000-18300 as on 1.1.2006 shall be eligible to be fixed in the Pay Band of Rs.37400- 67000 with AGP of Rs.9000.
(iv) All incumbents to the post of Deputy Director of Physical Education / Assistant Director of Physical Education (Selection Grade)/College Director of Physical Education (Selection Grade) whose services in the pre-revised Pay Scale of Rs.12000-18300 fall short of three years which would have made them eligible to move to the higher Pay Band, shall be placed at an appropriate stage at the AGP of Rs.8000 in the Pay Band of Rs.15600- 39100 till they complete the required service of three years as Deputy Director of Physical Education / Assistant Director of Physical Education (Selection Grade)/ College Director of Physical Education (Selection Grade) in the pre- revised Pay Scale.
(v) Pay of the directly recruited Deputy Director of Physical Education shall be initially fixed with the AGP of Rs.8000 in the Pay Band of Rs.15600-39100, and after completing 3 years of service directly recruited Deputy Director of Physical Education and equivalents shall move to Pay Band Rs.37400-67000 with AGP of Rs.9000.” https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025
14. Based on the interpretation of the Government Orders, the Director of Technical Education passed orders conferring the benefits of the career advancement scheme on various teaching staff with effect from various dates by his orders dated 08.07.2020 and these orders were subject matter of challenge in various writ petitions.
15. The fundamental contention of the Teachers who challenged these Government Orders is that the fixation of grade pay with effect from a date beyod 01.01.2009 is incorrect and those Teachers who complete the required period of service would be entitled to upgradation to grade pay of Rs.9,000/-
from 01.01.2009 and any postponement is against the spirit of the Government Order. Therefore, a mandamus was sought for directing the 2 nd respondent in the writ petition namely, Director of Technical Education to fix the Annual Grade Pay (herein after referred to as AGP) for the petitioner therein from 01.01.2009 at Rs.9,000/- with all consequential mandatory benefits, since he had completed 3 years of service in the annual grade pay of Rs.8,000/- from 01.01.2006 as stipulated under G.O.Ms.No.111 dated 25.05.2010.
16. The learned single Judge had accepted the said contention and issued certain directions for implementation. A further direction was issued that the respective Heads of Institutions would sanction and pass orders in respect of https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 earlier Government Orders for those who fall under G.O.Ms.No.111 dated 25.05.2010. The directions are mainly challenged by the State on the ground that conferment of benefits under G.O.Ms.No.111 is not automatic and is subject to the candidates obtaining the qualifications required under the said Government Order.
17. While conceding that the Government is not aggrieved by the final directions issued, the learned Advocate General would submit that it is the conclusion of the learned Judge that the candidates, who are in the selection grade Lecturer post as on 01.01.2006 in AGP of Rs.8,000/- would be eligible to move to the annual grade pay of Rs.9,000/- on completing of 3 years of service from 01.01.2006 i.e., on and from 01.01.2009 is not in tune with the requirements of the Government Order namely, G.O.Ms.No.111 dated 25.05.2010.
18. We have already extracted the schedule, which prescribed new pay scales and the relevant clauses in Appendix-I which govern the issue. As per G.O.Ms.No.1081 which relates to Polytechnic Teachers, the upgradation scheme introduced by the said Government Order on the basis of the number of years of service put in by the respective candidates. Under the said scheme, all Associate Lecturers with 10 years of experience and possessing the qualification required for Lecturer are entitled to be upgraded as a Lecturer on completion of https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 10 years of satisfactory service as Associate Lecturer. A Lecturer with 10 years of satisfactory service having qualification required for the Head Department is upgraded as the Head of the Department.
19. As per All India Council for Technical Education pay scales, there are Lecturers in the pay scale of 8000-275-13500 and Lecturers with Bachelors degree who have completed 9 years of service who come in the pay scale of 8000-275-13500, Lecturers with Bachelors degree and 6 years of service who come in the pay scale of 8000-275-13500, Lecturers who possess Post Graduation qualification or M.Phil., with 5 years of service, who come in the pay scale of 8000-275-13500 and Lecturers with Ph.D., and 4 years of service who also come in the same scale of pay. The scale of pay for different categories of Lecturers enumerated in Clauses 8, 9, 10, 11 & 12 of Schedule – II was one and the same, prior to introduction of G.O.Ms.No.111.
20. After the introduction of G.O.Ms.No.111, these Lecturers are classified into at least 5 categories namely, those with Ph.D., those with post graduation, those with Bachelors degree and 6 years of service, those with Bachelors degree and 9 years of service and those who are new entrants. As per the pay scales introduced by G.O.Ms.No.111, all these Lecturers were put in four different categories, while the scales of pay remained the same namely, 15600 to 39100 for all of them. The grade pay differed from 5400 to 7000 https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 depending on the qualification. The Senior Lecturers also came under the same basic pay band of 15600 – 39100 but, those Lecturers with more than 5 years of service in the annual grade pay of 7000 were granted a grade pay of 8000 and Lecturers with less than 5 years of service were granted an annual grade pay of Rs.7000/- apart from the basic pay.
21. As regards upgraded Heads of Departments, those who were in the pay scale of 12000 to 18300 for a period of 3 years were put in the pay band equal to that of Head of the Department namely, 37400 – 67000 with annual grade pay of 9000. Those upgraded Heads of Department who had not completed 3 years in the pre-revised scales of pay in the pay band of Rs.12,000 – 18300 as on 01.01.2006 were put in the pay band of 16300 – 31900 + annual grade pay of Rs.8000/-. It is based on the above, the career advancement scheme has to be worked.
22. We have already extracted the details of the career advancement scheme set out in the Appendix-I to the said Government order. There is no difficulty in interpretation of these Clauses upto Clause X of the Appendix-I. The difficulty arises only in dealing with Clauses XI, & XII. Clause XI provides with incumbent Lecturers (Selection Grade) who had not completed 3 years in the pay scale of 12000-18300 as on 01.01.2006 shall be placed in the appropriate stage in the pay band of 15600-39100 with annual grade pay of https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 8000 till they complete 3 years of service in the grade Lecturer (Selection Grade) and thereafter, shall be placed in the higher band of 37400 – 67000 and accordingly, designated as Lecturers (Selection Grade).
23. It should be pointed out at this juncture that no increase in the grade pay of Rs.8000 is recommended for those Lecturers (Selection Grade) who complete 3 years in the pre-revised pay scale of 12000 – 18300 after 01.01.2006. The distinction made can be better understood by referring to Clause-X of Appendix-I which provides that incumbent Lecturers (Selection grade) who have completed 3 years in the pre-revised scale of pay of Rs.12000 – 18300 on 01.01.2006 shall be placed in the pay band of 37400 – 67000 with AGP of 9000 and shall be designated as Lecturers (Selection grade).
24. Clauses XII is the most crucial clause which makes Lecturers (Selection Grade) who have completed 3 years of teaching with AGP of 8000 shall be eligible to subject to other conditions as may be prescribed by the AICTE / State Government to move to the pay band of 37400 – 67000 with AGP of 9000. It is this crucial condition subject to other conditions as may be prescribed by the All India Council for Technical Education / State Government that has been overlooked by the learned single Judge is the contention of the learned Advocate General appearing for the appellants.

25. Mr.P.S.Raman, learned Advocate General would strenuously contend that those Lecturers (Selection Grade) who had completed 3 years in the pre-
revised pay band of 12000 to 18300 on 01.01.2006 namely, the date of coming into force of G.O.Ms.No.111 will be automatically placed in the highest pay band namely, 37400 – 67000 along with the grade pay of 9000. Those Lecturers (Selection grade) who had achieved that position prior to 01.01.2006 and who had not completed 3 years of service in that position as on 01.01.2006 by operation of Clause – XI would be placed in the appropriate stage in the next pay band of 15600 – 39100 with an AGP of Rs.8000 till they complete 3 years and, upon completion of 3 years, they will be placed in the highest pay band of 37400 – 67000 but, the grade pay will remain only at 8000. The revision of grade pay to Rs.9000 will be subject to fulfilment of other conditions that may be prescribed by the AICTE and the State Government.
26. Mr.G.Sankaran, learned Senior Counsel and Mrs.Nalini Chidambaram, learned Senior counsel appearing for the petitioners in the writ petitions who are Polytechnic Teachers would vehemently contend that G.O.Ms.No.111 was passed only on 25.05.2010 and by that time, the petitioners had completed 3 years in the pre-revised pay scale of 12300 – 18300 therefore, they were automatically entitled to a grade pay of Rs.9000 and the said benefit cannot be taken away by the subsequent Government Orders.

27. While the learned Advocate General would attempt to impress upon us that what is granted under G.O.Ms.No.111 is a new benefit, of course with effect from an anterior date and while doing so, it will be open to the employer to prescribe certain additional qualifications. This cannot be construed as withdrawing the benefit which has already accrued to an employee. The task before us is to interpretation of Clauses XI & XII of the Appendix-I to G.O.Ms.No.111 in respect of Polytechnic Teachers.
28. As we have already adverted to, Clause X of Appendix – I, straight away confers the benefits of the highest pay scale with an AGP of 9000 on incumbents, who were classified as Lecturer (Selection Grade) who had completed 3 years in the pre-revised scale of pay 12000-18300. If we are to look at Schedule-I, the pre-revised scales of pay 12000-18300 was applicable to an upgraded Head of the Department and the Head of the Department. The upgraded Head of the Department, as per the upgradation scheme set out in G.O.Ms.No.1081 is a Lecturer with satisfactory service of 10 years as a Lecturer and having the qualification for Head of the Department. Therefore, a person who has been occupying the position of the Head of the Department or a person who has been upgraded as a Head of the Department, 3 years prior to 01.01.2006 will straight away take the benefit under Clause – X. Those, who had not completed 3 years in the pay band of 12000 – 18300 as on 01.01.2006, will come under the sweep of Clause XI.

29. The mandate of Clause – XI is that those Selection grade Lecturers, who had not completed 10 years in the pay band of 12000 – 18300 as on 01.01.2006 shall be placed at the appropriate stage depending upon the period of service completed by them in the pay scale of 12000 – 18300 in the pay band of 15600 – 39100 with an annual grade pay of Rs.8000 till they complete 3 years of service in the said position. Thereafter, they will be placed in a higher pay band of 37400 – 67000. The grade pay will however, continue to be at 8000, upon completion of 3 years with an annual grade of 8000, the movement to the next grade i.e., annual grade pay of Rs.9000 is not automatic and it is governed by Clause-XII which requires other conditions as may be prescribed by the AICTE / State Government to be complied with. It is here, the issue surfaces.
30. The question as to whether it is open to the Government to insist on a particular qualification with effect from an anterior date for conferment of certain benefits. The Government order itself is not challenged. The AICTE norms require certain other qualifications as set out in Clause – XVI which includes completion of refresher programmes and technical education quality improvement programmes. After the introduction of the AICTE faculty norms, there is also a further requirement of post graduation for the post of Head of the Department.

31. It is the contention of Mr.G.Sankaran that the faculty norms introduced by G.O.Ms.No.111 dated 25.05.2010 would only be prospective in nature and they cannot take away the rights vested in the Teachers prior to its issuance namely, prior to 25.05.2010. Therefore, according to the learned counsel, the insistence upon the additional requirements introduced by the Government Order for conferring benefits under the career advancement scheme would really amount to taking away the rights that had vested int he Teachers prior to the issuance of G.O.Ms.No.111. The learned Advocate General would however, elaborating on the submissions, point out that a benefit that has been conferred cannot be taken away but, it is open to the employer to prescribe possession of certain qualifications in order to take a benefit conferred under a career advancement scheme which comes into force with a limited retrospective effect.
32. Drawing our attention to the difference in language between Clauses X & XI of Appendix-I, the learned Advocate General would submit that an upgraded Head of the Department who has been in the pay scale of 12000 – 18300 for more than 3 years under Schedule – II gets a right to move to the revised pay scale of 37400 – 67000 with an annual grade pay of 9000 but, an upgraded Head of the Department with less than 3 years with a pre-revised pay band of 12000 – 18300 as on 01.01.2006 moved only to the pay band of 15600 – 39100 with an annual grade pay of 8000. The further movement to annual https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 grade pay of 9000 is governed by Clause – XII which prescribes a certain other conditions. This prescription, according to the learned Advocate General cannot be treated as taking away a right which is already vested in the Teachers.
33. It is open to the Employer to insist upon possession of certain qualification for being conferred a benefit under the career advancement scheme which is introduced with a retrospective effect. Of course, the learned single Judge had held that the applicability of G.O.Ms.No.111 would only be prospective and it would only apply to those who acquired the necessary qualifications after 25.05.2010. The said interpretation of the learned Judge would militate against the specific language used in Clauses XI & XII of the Appendix – I is the say of the learned Advocate General.
34. No doubt, in service jurisprudence, it is not open to the employer to withdraw a benefit retrospectively or even prospectively, if the benefit had already accrued to the employee. What is sought to be achieved by G.O.Ms.No.111 is to insist upon a certain qualification for moving to the next stage in the grade pay. Clause XI provides that a Lecturer (Selection Grade) who had not completed 3 years of service as on 01.01.2006 in the pay scale of 12000 – 18300 will be placed in the appropriate stage in the pay band of 15600 – 39100 with an annual grade pay of 8000 till they complete 3 years in the said pay band. Another benefit is also provided in Clause – XI that those persons https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 will be moved to the next higher pay band of 37400 – 67000 upon completion of 3 years. The only benefit that is not given to them is movement to the next grade in the annual grade pay i.e., from 8000 – 9000 which is made subject certain conditions that may be prescribed by the AICTE or the State Government. This, in our considered opinion, cannot be construed as withdrawal of benefit that had already accrued to them. Therefore, in respect of Lecturers in Polytechnics, career advancement scheme will be governed by by Appendix-I of G.O.Ms.No.111 dated 25.05.2010. The benefit of a higher scale of pay as well as a higher annual grade pay will depend on their complying with the requirements of the AICTE / State Government.
35. Mrs.Nalini Chidambaram, learned Senior Counsel appearing for some of the Polytechnic Teachers would submit that the AICTE regulations with reference to training programmes has been deferred. As already stated, we do not propose to go into individual cases. The decision on individual claims will be taken by a Committee that is to be constituted by us and if the Committee finds that the individual Lecturer satisfies the requirements set out in G.O.Ms.No.111, they will be granted the benefit.
36. Moving on to the case of Engineering College Teachers, the same is governed by G.O.Ms.No.95 dated 05.05.2010. (x) Incumbent Assistant Professor who have less than 3 years in current pay scale of Rs 12000-18300 on 1 3.2006 shall be placed at the appropriate stage in the Pay Band of Rs. 15600-
39100 with AGP of Rs 8000 and shall be designated as Assistant Professor.
(xi) Incumbent Lecturers (Selection Grade) who have completed 3 years in the pre-revised pay scale of Rs 12000-18300 on 1.3.2006 shall be placed in Pay Band of Rs.37400-67000 with AGP of Rs 9000 and shall be re-designated as Associate Professor.
(xii) Incumbent Lecturers (Selection Grade) who had not completed three years in the pay scale of Rs 12000-18300 on 1.3.2006 shall be placed at the appropriate stage in the Pay Band of Rs 15600-39100 with AGP of Rs.8000 till they complete 3 years of service in the grade of Lecturer (Selection Grade), and thereafter shall be placed in the higher Pay Band of Rs. 37400- 67000 and accordingly re-designated as Associate Professor.

(xv) Associate Professor completing 3 years of service in the AGP of Rs. 9000 and possessing a PhD degree in the relevant discipline shall be eligible to be appointed and designated as Professor, subject to other conditions of academic performance as laid down by the All India Council for Technical Education / State Government / Universities. No teacher other than those with a Ph.D. shall be promoted, appointed or designated as Professor. The Pay Band for the post of Professors shall be Rs. 37400-67000 with AGP of Rs 10000.”
38. We find this Government Order, though similarly worded is little different from G.O.Ms.No.111. The Assistant Professors, who have completed 3 years in the current pay scale of 12000 - 18300 as on 0103.2006 are to be placed in the appropriate stage of the pay band of 37400-67000 with an AGP of 9000 and are to be re-designated as Associate Professors. Those Assistant Professors, who have not completed 3 years in the pay scale of 12000 - 18300 as on 01.03.2006 are to be placed in the pay band of 15600 - 39100 with an AGP of 8000 and they are to be designated as Associate Professors. Those Lecturers (Selection Grade), who have not completed 3 years in the pay band of 12000-18300 as on 01.03.2006 are to be placed at the appropriate stage in the pay band of 15300-39100 with AGP of 8000 till they complete 3 years of service in the grade of Lecturer (Selection Grade) and thereafter, shall be placed in the higher pay band of 37400-67000 and re-designated as Associate Professors. Lecturers (Selection Grade), who do not qualify for re-designation as Associate Professor as per Clause-12 of the Appendix-I are to be continued to be designated as Selection Grade Lecturers until they are placed in the pay band of 37400-67000 as provided under Clause-12.
39. The issue arises only in respect of Clauses 14 & 15 of Appendix-I to G.O.Ms.No.95. Clause 14 extracted above makes it clear that Assistant Professors, who complete 3 years of Teaching in the AGP of 8000 i.e., those falling under Clause-10 shall be eligible subject to other conditions that may be prescribed by the AICTE / State Governments / Universities as applicable will move to the pay band of 37400 - 67000 with AGP of 9000 and be designated as Associate Professors. This clause imposes a further condition apart from completion of a particular period of service namely, satisfaction of the conditions prescribed by the AICTE / State Governments / Universities to enable movement to the higher pay band.

40. Those Assistant Professors, who are in the AGP of 8000, upon completion of 3 years of service will not automatically move to the pay band of 37400-67000 with AGP of 9000. Their movement will be subject to fulfilment of further conditions. Similarly, as per Clause - 15, an Associate Professor who completes 3 years of service in the AGP of 9000 and possessing a Ph.D. degree is to be designated as a Professor subject to the other conditions of academic performance as laid down by the AICTE / State Governments / Universities. No Teacher, who does not have a Ph.D. can be designated as a Professor in the band of 37400-67000 with AGP of 10000.
41. The Government Order makes the distinction between persons, who had completed 3 years of service in a particular pay band, prior to 01.03.2006 and, persons who have not completed 3 years of service in that pay band on 01.03.2006. This classification, in our opinion is reasonable and it is open to the employer to introduce a further requirement in order to confer certain mandatory benefits on certain employees. Therefore, a movement under the career advancement scheme does not only depend upon completion of particular period of service in a particular pay scale but, it is made subject to satisfaction of certain other conditions. Whether an individual Lecturer will satisfied the conditions imposed will have to be gone into by the Committee that is to be appointed us for the purpose of finding out the individual qualifications.

42. We only broadly lay down the requirements of the relevant clauses of Appendix – I of the Government Order. By virtue of Clause – 13, a Selection Grade Lecturer in service will continue to be designated as a Lecturer (Selection Grade) until they are placed in the pay band of 37400-67000 and re-designated as an Associate Professor as prescribed in Clause-12 above. The further qualifications that are required are only in respect of Assistant Professors, who are drawing an AGP of 8000 i.e., those, who have served less than 3 years as Assistant Professors will have to satisfy the conditions for being designated as an Associate Professor and Associate Professors, who complete 3 years in the AGP of 9000 will have to possess the Ph.D., for being designated as a Professor in a higher AGP of 10000.
43. The contention of Mrs.Dakshayini Reddy, learned Senior Counsel appearing for the Engineering College Professors is that the case of Engineering College Professors do not come under CAS and it is only a case of re-
designation. Appendix-I prescribes the pay structure for different categories of Teachers and as per Schedule-II apart from Principal and Professors, there are at least six categories of Teachers, who are designated as Assistant Professors, Lecturers (Selection Grade) and Lecturers (Senior Grade) by upgradation and Lecturer. The Assistant Professors, who are in the pay band of 12000-18300, who have completed more than 3 years of service are placed in the pay band of https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 37400-67000 with an AGP of 9000. Those in the same category, who have less than 3 years of service are placed in the pay band of 15600-39100 with AGP of 8000.
44. Similarly, Lecturers (Selection Grade) who are in the pay band of 12000 – 18300 for more than 3 years are placed in the pay band of 37400-67000 with an AGP of 9000. Lecturers (Selection Grade) with less than years in the pay band of 12000-18300 on equal terms with Assistant Professors who have less than 3 years in the pay band of 15600-39100+AGP of 8000. Lecturer (Senior Grade), who are in the pay band of 10000-15200 are placed in the pay band of 15600-39100+AGP of 7000. Lecturers, who are in the pay band of 8000-13500 are re-designated as Associate Professors and their pay band is fixed at 15600-39100+AGP of 6000.
45. The parties are at issue only on the wordings of Clause XIV & XV.
We have already held that it will be open to the Employer to prescribe further qualification to enable a person to move to the next level and the same cannot be construed as taking away a right conferred that has accrued to them. Clause – 11 of Appendix-I to G.O.Ms.No.95 provides for movement of Lecturers (Selection Grade) who have completed 3 years in the pre-revised scale of pay of 12000-18300 as on 01.03.2006 to move to the next higher pay band of 37400- 67000 with AGP of 9000 but, those Lecturers (Selection Grade) who have less https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 than 3 years are placed in the pay band of 37400-67000, on completion of 3 years of service but, their grade pay remains at 8000. Their movement to the grade pay of 9000 is made subject to their satisfying the other conditions that may be prescribed. These conditions are prescribed by the AICTE in its regulations. Therefore, those Assistant Professors who are in the AGP of 8000 upon completion of 3 years of service in that category would not automatically move to the higher AGP of 9000 unless they comply with other requirements.
The learned Advocate General has also not disputed the fact that once they satisfy the conditions or acquire the qualification that is required namely, either PG or Ph.D., they would be automatically given the benefit.
46. Now third set of cases relate to the Physical Education Directors. As far as the Physical Education Directors are concerned, they are all working in Polytechnics so, G.O.Ms.No.111 would apply to them. Schedule-II of G.O.Ms.No.111 classifies the Physical Education Directors into three categories there, Physical Director with PG qualification in the pay band 8000-13500, revised pay band of 15600-39100 with AGP of 6000. Physical Director (Senior Grade) in the pay band of 10000-15200, revised pay band 15600- 39100+AGP7000. Physical Education Directors (Selection Grade) in the pay band of 12000-18300 with 3 years of experience in that scale of pay before 01.03.2006 in the pay band of 15600-39100+AGP9000. In those Physical Directors in the Selection Grade who have not completed 3 years as on https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 01.03.2006 are to be placed in the pay band of 15300-39100 with AGP of 8000.
47. As far as the career advancement scheme, set out in Appendix-I which is governed by Clause-IV of Appendix-I of G.O.Ms.No.111 dated 25.05.2010, a Physical Education Director by whatever name he is called who was in the pre-
revised scale of pay of 8000-13500 is placed in the pay band of 15600-39100 with AGP of 6000. Pay of incumbent Assistant Directors of Physical Education / College Director of Physical Education is to be fixed at the appropriate stage of the pay band depending on the period of service with an AGP6000. As per Sub-clause-B of Clause-4 of Appendix-I, Physical Education Director (Senior Scale) which is in the pre-revised scale of 10000-15200 is to be placed in the pay band of 15600-39100 with AGP of 7000. Those Physical Education Directors by whatever name they were called, possessing Ph.D., will be moved to higher AGP of 7000 in the pay band of 15300-39100, upon completion of 4 years of service in the AGP of 6000.
48. The Assistant Directors of Physical Education and the College Directors of Physical Education in the senior scale who have a M.Phil., degree in Physical Education will move to the AGP of 7000 after completion of 5 years of service in the AGP of 6000. Those, who do not possess Ph.D., or M.Phil., degrees will move to the AGP of 7000, after completion of 6 years in the AGP of 6000. Sub-clause – C of Clause-4 provides for further movement in AGP of https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 8000 but, this makes the movement subject to satisfying other eligibility conditions laid down by the AICTE / State Government.
49. Of course, the learned counsel for the respondents would contend that the imposition of conditions would take away the right vested in them. We have already while considering the cases of Lecturers in Polytechnics and Engineering Colleges concluded that this will not amount to taking away the right vested in them and it is open to the Employer to prescribe certain conditions in order to confer certain benefits on the employees. Once it is made clear that upon obtaining the eligibility conditions, these Physical Education Directors will also be moved to the higher scale of pay along with the higher AGP therefore, we do not see any substance in the submission of the learned counsel.
50. In view of the above conclusions, we find that remitting the matters to the Heads of Institutions may not serve the purpose. We therefore, constitute a High Power Committee consisting of Mr.M.P.Vijayakumar, a retired Senior IAS Officer, Mr.V.Vijay Shankar, Advocate practising in this Court, who handles quite a number of service law cases and the Director of Technical Education.
The Committee will examine the credentials of each candidate and fix the benefits that they would be entitled to under G.O.Ms.No.111 dated 25.05.2010 and G.O.Ms.No.95 dated 05.05.2010. Needless to point out that the Committee https://www.mhc.tn.gov.in/judis ( Uploaded on: 08/01/2026 05:54:58 pm ) WA No. 1769 of 2025 will go by the conclusions arrived at by us supra. The Director of Technical Education will also serve as the Secretary of the committee.
51. We direct the State Government to pay a sum of Rs.2,50,000/- each as initial remuneration to the Committee Members except the Director of Technical Education who is already on the pay role of Government. The directions issued by the learned single Judge in all these cases are set aside and these writ appeals will stand partly allowed. It will be open to the parties to make a written representation to the Committee elaborating their entitlement and the claims.
The parties will bear their own costs in these appeals. Consequently, connected miscellaneous petitions are closed.
