40. Penalties.
(1)If any person contravenes any of the provisions of this Act, he shall except as otherwise provided in section 15, be punishable with imprisonment for a term which may extend to two years or with fine or with both.(2)Whoever fails to comply with any direction made or deemed to have been made under this Act shall be punishable with imprisonment for a term which may extend to one year or fine or with both.Provided that the Controller trying any offence under this Act may order the whole or any part of the fine recovered to be applied to the payment to any person as compensation for any loss caused by the offence.CHAPTER- IX Miscellaneous
