Facts:­ 

1. Shri   H   K   Soni   submitted   RTI   application   dated   13   July  2011   before   the   CPIO,   Ministry   of   Statistics   and   Programme  Implementation, New Delhi to obtain information regarding the  status of memorandum dated 3 March 1998.

2. Vide   CPIO   order   dated   3   August   2011,   appellant   was  informed   that   due   to   a   fire   which   occurred   on   10   February  2001, all the records  held in  Divisional office, Shimla  had  been   destroyed   and   therefore   the   requested   information   could  not be furnished.

3. Appellant   preferred   appeal   dated   24   August   2011   before  the first appellate authority. 

4. Matter was disposed of vide FAA order dated 15 September  2011   vide   which   the   facts   provided   by   the   CPIO   were  reiterated.

5. Appellant preferred second appeal before the Commission. 

   Appeal: No. CIC/DS/A/2011/003679       

6. Matter was heard today via videoconferencing from Shimla  and   Jaipur   where   respondent     as   above   were   present.   DDG  (headquarters), NSSO, appeared in person. Appellant was heard  from Solan.

7. After   hearing   all   the   parties,   Commission   upholds   the  orders   of   the   CPIO   and   the   first   appellate   authority.  Appellant   is   warned   not   to   pursue   the   matter   of   seeking  information   which   does   not   exist   in   material   form   with   the  appellant   as   in   doing   so   he   is   only   wasting   the   scarce  resources  of the public  authority  and the Commission.  Appeal  is dismissed.
