Mr. Asish Kumar Roy ... ... for the petitioners Mr. Tapabrata Chakraborty, Mr. Barun Chatterjee ... ... for the respondent No. 1 This writ petition has been filed assailing the judgment and order dated 2nd January, 2013 passed by the Central Administrative Tribunal, Calcutta Bench whereby and whereunder the said learned Tribunal quashed the order passed earlier by the appellate authority and directed the said appellate authority to pass a fresh order.

Since the appellate authority has been directed to pass a fresh order in the light of the observations made by the learned Tribunal, we are of the opinion that no direction should be issued by this court at this stage. The appellate authority should pass an appropriate order in compliance with the direction of the learned Tribunal. Since the time limit prescribed by the learned Tribunal has already expired, we extend the time limit to the said appellate authority by a period of four weeks 2 for complying with the direction passed by the learned Tribunal.

With the aforesaid observations and directions, this writ petition stands disposed of.

There will be, however, no order as to costs. Let urgent xerox certified copy of this order, if applied for, be given to the learned Advocates of the parties on usual undertaking.
